PUBLIC HEARINGS:  

Chairman, Robert Geotsch opened the public hearing at 7:00pm

 

Chairman, Robert Geotsch read the following:

 JANKOSKI ( 42.12-1-20)  2 Lake Forest Lane (TR-1)

The applicant is applying for an after-the-fact approval for a multi-family dwelling.  The owners have made a basement apartment in a single family home on a .33 acre lot.  Zoning issue:  160-56 Multi-family dwelling & 160-23 TR-1 (2) (a)

ZEO, Cathy Clark read numerous letters against the application.  Letters are on file in the ZEO’s office. There were also three people that also spoke against the application.

Mr. and Mrs. Jankoski spoke in favor of the application.

Chairman, Robert Geotsch made a motion to close the public hearing at 7:40pm. Martin Fitzgerald 2nd the motion.

Roll call vote: Yea: Robert Geotsch, Martin Fitzgerald, Lindsay Mydlarz and George Ianson.

Nays: none

Motion passes: 4-0

 

CALL MEETING TO ORDER: Chairman, Robert Geotsch called the meeting to order at 7:41pm.

 

INTRODUCTION OF BOARD MEMBERS:

 Chairman, Robert Geotsch,  Martin Fitzgerald, Lindsay Mydlarz, George Ianson and ZEO, Cathy Clark. Absent: Glenn McKee Bill Pittman, and Jon Hanna

 

APPROVAL OF MINUTES: MEETING OF: January 28, 2010

George Ianson made a motion to approve the minutes of January 28, 2010. Lindsay Mydlarz 2nd the motion.

Roll call: Yea:  Robert Geotsch, Martin Fitzgerald, Lindsay Mydlarz and George Ianson.

Nays: none

Motion passes: 4-0

 

OLD BUSINESS:  

Chairman, Robert Geotsch read the following:

 JANKOSKI (42.12-1-20)  2 Lake Forest Lane (TR-1) The applicant is applying for an after-the-fact approval for a multi-family dwelling.  The owners have made a basement apartment in a single family home on a .33 acre lot.  If the ZBA approves the variance request a Type II site Plan Review will be required.

Zoning issue:  160-56 Multi-family dwelling & 160-23 TR-1 (2) (a)

George Ianson made the statement, for clarification, that the application was not about the rental of the house and not about protecting association rules or regulations.  It was about granting an exception to the Zoning Codes of Hague.  Variances approvals are granted on a case by case basis and are based on a proven a hardship to the property.

George Ianson made the motion to deny the request for a variance. Martin Fitzgerald 2nd the motion.

George Ianson reviewed the conditions for Variance Determinations

a.      Will an undesirable change be produced in the character of the neighborhood or to the detriment of nearby properties?

Yes, it would be a rental in a single dwelling.

b.      Can the benefit sought by the applicant be achieved by some method feasible to the applicant other than an area variance? Yes, the in-laws or guest can stay in the home however it does not need to be used as a rental.

c.       Is the requested variance substantial? Yes, it would provide occupancy and separate dwelling units for more than one family.

d.      Will the proposed variance have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district?

Yes, considering the use of the private beach area, but not of the home itself.

e.       Is the alleged difficulty self-created? Yes.

 

Roll call: Yea: Robert Geotsch, Martin Fitzgerald, Lindsay Mydlarz and George Ianson.

Nays: none

Motion passes: 4-0
