PUBLIC HEARINGS:
ZEO, Cathy Clark read the following:
RIZZA (43.13-1-22) 28 Bayberry Lane (TR-1)
The applicants would like to construct a two story addition to a legal non-conforming house. The plans call for the run-off of the structure to drain into existing and proposed flower beds. The property is located within Sewer District #1. APA has returned their Jurisdictional Determination of non-jurisdiction.
Zoning issues: 160-62 more than a 25% increase to a legal non-conforming structure.
160-23 Sideline setbacks
ZEO, Cathy Clark read a faxed that that she had received from Attorney John Breitenbach on behalf of John and Denise Bambach. The letter requested a postponement of the public hearing to allow the Bambach’s sufficient time to review the proposal, seek professional advice and respond appropriately to the Zoning Board of Appeals. Due to the Bambach’s receiving the notice of the public hearing four days prior to the hearing because of an incorrect mailing address. Attorney, John Breitenbach was in attendance of the public hearing on behalf of the Bambachs.
George Stanford, President of Cape Cod Associations was also in attendance for the public hearing. Mr. Stanford spoke in favor of the application. Stating that The Cape Cod Association Board of Directors and Architect Committee has approved Rizza’s plans. However, Mr. Stanford would not object to the postponement so that the Bambach’s have time to review the application. Mr. Stanford also agreed to send the Zoning Board a letter of approval from The Cape Cod Association.
Martin Fitzgerald made the motion to keep the public hearing open for 30days. George Ianson 2nd the motion

(PUBLIC HEARING REGARDING RIZZA CONTINUED)
Attorney John Breitenbach, in attendance on behalf of John and Denise Bambach stated that the Bambachs are against the application. Mr. Breitenbach reviewed the letter that he sent to the Zoning Board of Appeals that contains concerns of John and Denise Bambach.
Michael Rizza stated that he was against postponing the Public Hearing.

Planning Board Referral to the ZBA:
After discussing the contents of the application Bruce Clark made the motion to recommend approval of the application, as submitted, with the following conditions: A native vegetative buffer be planted along the brook.. A more detailed Stormwater retention plan be submitted and implemented for the entire structure. Pam Peterson seconded the motion. Motion passed 5-0 vote.
The Board made a motion to keep the Rizza Public Hearing open for thirty (30) days.
