Chairman Robert Goetsch opened the public hearing for
KOSSBIEL (12.14-1-21) 9651 Lakeshore Drive, OC-1 at 7 pm.
John Kossbiel, co-owner with son-in-law David Defazio and daughter, Heather, gave additional information. The property was subdivided in 1984 and an abstract was done. From the information he got from the company that did the abstract, he presented an outline of lot 7 which belongs to Doulin, his neighbor to the south. From that he established the front property line at 50 ft and 18 ft between 2 the two buildings. He also has the survey from his neighbor, Ticknor, if that is needed. Mr. Kossbiel said he doesn’t have a survey for his property but the property line can be established from the outlines he presented. Mr. Ianson said that they knew where the proposed steps were going to be placed by the staked out area but didn’t know where the property line was.
There were no other speakers either for or against.
Mr. Goetsch suggested that they adjourn the public hearing to the August meeting so that the Board can do another site visit based on the new information and see if a survey is necessary.
Chairman Robert Goetsch opened the regular meeting at 7:10 pm with members Glenn McKee, George Ianson, Bill Pittman, Lindsay Mydlarz and Martin Fitzgerald, II also in attendance. Donna Charboneau was absent.
George Ianson made a motion to accept the minutes of June 26, 2008 as written and it was seconded by Bill Pittman. All members voted in favor and the minutes were accepted.

Chairman Goetsch said they will bypass the KOSSBIEL application until next month.
New Business:
BENEDUCE (93.19-1-8)7776 Lakeshore Drive RC
Chairman Goetsch read:
The applicant is proposing to construct a 1026 sq. ft. two story addition to a nonconforming house. If approved, a portion of existing structure will be removed. There will be an 89% increase in living space. The new addition will be 54 feet from the Lake and be located on the west side of the current structure. The zoning issues are 160-31 A - Maximum lot coverage and
160-62 A - nonconforming structures.
Martin Fitzgerald made, and Glenn McKee seconded, a motion to deem the application complete and put it on the agenda for next month. All members voted in favor and the motion passed.

MILLER (43.17-1-7) 27 Springdale Manor Drive TR-1
Chairman Goetsch read:
The applicant would like to build a 392 sq. ft. addition to an existing nonconforming house. The addition would be an increase of 50% to a nonconforming structure. Zoning issue: 160-62 A - Nonconforming structures.
Glenn McKee made, and Lindsay Mydlarz seconded, a motion to deem the application complete and put it on the agenda for next month. All members voted in favor and the motion passed.
AYES: Goetsch, McKee, Ianson, Pittman, Mydlarz and Fitzgerald.
Site visits were set for Thursday, July 31, 2008 at 7 pm for Kossbiel, Beneduce and Miller.
Other Business:
Donna Wotton asked the Board if she could speak for a group of Overbrook Road neighbors, some of whom were also present, about issues they were having with the Patchett property on Overbrook Road.
A new structure is being built on Overbrook Road by Scott Patchett. The permit was issued for a single family residence but there are renters there and it is part of the Trout House business as evidenced by the Trout House cleaning crew coming in daily. They also do not yet have a certificate of occupancy for the building and the stormwater run-off permits have expired. In a recent heavy rain, the mud from the property flowed over 4 neighbor properties.
Chairman Goetsch said that the certificate of occupancy would be an issue to take up with the Warren County Building department. He said the other issues are not Zoning Board of Appeals issues.
Donna also asked what was being done about an earlier concern about the parameters on rental of single family homes. The response was that it was a Town Board issue and was sent to a committee chaired by Councilman Dick Gladu which has not met since October.
ZEO Clark noted that in the hamlet for a residence to be used as a commercial business there would have to be a change of use approved by the Planning Board. She also noted that an earlier petition by the Overbrook neighbors had been given to the Planning Board and they recommended giving it to the owner of the property.

Lindsay Mydlarz made, and George Ianson seconded, a motion to adjourn the meeting. All members voted in favor and the motion passed and meeting adjourned at 7:20 pm.
