Chairman Robert Goetsch called the meeting to order at 7 pm. Also in attendance were Bill Pittman, Lindsay Mydlarz, George Ianson and Glenn McKee. Martin Fitzgerald, II and Donna Charboneau were absent.
On a motion by Glenn McKee and a second by Lindsay Mydlarz, the minutes of March 27, 2008 were approved.
Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee, Pittman
OLD BUSINESS: None
NEW BUSINESS:
1. JOHNSON (12.18-1-16) Lakeshore Drive (TR-1)
Chairman Goetsch read the following: The applicant would like to replace an existing 459 sq. ft. structure and deck with a new 512 sq. ft. structure and deck. The existing structure sits 1 foot from the MHW of Lake George. It is located on the south side of the parcel. If approved the structure/cabana and deck will sit 8 feet from the MHW of the lake and have no living accommodation within. The owner proposes building the structures on the north side of the property, so they may access an existing dock cribbing. Zoning issue: 160-50 B (b) Shoreline setbacks
Cathy Clark mentioned she had concern about the facilities and that they have said they will be using a chemical toilet. Brian Grisi of the APA has stated that this is not a replacement in kind and suggested planting trees for every one that is removed.
Lindsay Mydlarz moved to deem the application complete and put on the agenda for a public hearing next month. George Ianson seconded the motion. Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee, Pittman
The Board will meet at the Community Center at 6 pm on Monday, April 28th for a site visit to this property.
2. NAVITSKY (93.19-1-10) 7763 Lakeshore Drive (RC)
Chairman Goetsch read the following: The applicant would like to expand and relocate a previously approved garage ( 3-23-06). They also would like approval for a 96 sq. ft. shed which has been place upon the lot. This would require relief from a condition placed on the 2006 approval from the Zoning Board of Appeals. Zoning issues 160-31. (A) RC rear and front line setbacks and relief from conditions of approval.
Mr. Navitsky appeared before the Board and mentioned he had filled out the application based just upon building square foot and in speaking to ZEO Clark found out that was in error. It should include all impervious area. The new information was presented to the Board which included less area with a change in the driveway.
He also stated that he found out that he does not need a building permit but does need a land use permit.
Glenn McKee moved to deem the application complete and put on the agenda for a public hearing next month. Lindsay Mydlarz seconded the motion. Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee, Pittman
The Board will also do a site visit on this property on Monday, April 28th. Mr. Navitsky will have the garage area staked out.
3. VAN BUSKIRK (93.19-1-2) 7796 Lakeshore Drive (RC)
Chairman Goetsch read the following: The applicant would like to install a 176 sq. ft. patio of pavers with a crushed rock base on a legal nonconforming lot. The existing house now covers 15.9 % of the lot. If approved the patio would be a .35 % increase. A landscape plan has been submitted. Zoning issues: 160-31 (A) RC percentage of coverage.
Mr. Van Buskirk appeared to discuss his plans. Bill Pittman moved to deem the application complete and put on the agenda for a public hearing next month. Lindsay Mydlarz seconded the motion. Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee, Pittman
The Board will also do a site visit on this property on Monday, April 28th and Mr. Van Buskirk said it will be staked.
OTHER BUSINESS:
1. Marschner (43.17-1-6) 29 Springdale Manor (TR-1)
Chairman Goetsch read the following: On April 26, of 2007 the Zoning Board of
Appeals approved an application for a 110% addition to an existing non-conforming
house with the condition that there be no increase to the existing foot print. Due to the
fact that most of the existing first floor structural components were not sound, the
applicant has had to replace most of it. This has made it a more of a total replacement
instead of an addition to the existing, requiring Site Plan approval. Zoning issues:
160-62 Continuation of a non-conforming structure.
George Ianson moved that no additions to the original variance were needed. Glenn McKee seconded the motion. Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee, Pittman
Lindsay Mydlarz moved that the meeting be adjourned and Glenn McKee seconded the motion. Vote: Carried, 5-0. Ayes: Goetsch, Mydlarz, Ianson, McKee and Pittman
The meeting was adjourned at 7:25 pm.
