Public Hearings

 

Rebenack (93.16-1-33) Sabbath Day Point Rd. TR1R

The applicant wishes to replace an existing house with a new log home. They are requesting a variance for the proposed increase of 281 sq. ft. to the deck area. Proposed construction is within 100 ft. of the shoreline.

 

The Notice of Public Hearing, as it appeared in the Post Star of 5/12/2006 was read by Cathy Clark.

 

No one in attendance spoke for or against the project.

 

Stanford (43.13-1-29) Bayberry Lane TR1

The Stanfords wish to build a 10 x 20 ft. sun porch addition, maintaining the 6 ft. sideline setback.  There are no plans to heat the porch.

 

Cathy Clark read the Notice of Public Hearing, published on 5/12/2006 in the Post Star.

 

The following letters were read by Cathy Clark:

            Walter and Helen Hartl, neighbors, dated 5/14/2006 stating no objection.

Ronald Harrison, dated 5/17/2006, objecting on the grounds that it will make the area too crowded.

 

Mr. Stanford addressed the Board. He stated that no neighbors in Cape Cod Village have objected and the Architectural Committee has approved the proposal.

 

No one else chose to speak for or against the project.

 

A motion to close the Public Hearing at 7:06 pm was heard from Bill Pittman and seconded by Tina King.

Vote: Carried, 6-0

Regular Meeting

 

The regular meeting of the Zoning Board of Appeals began immediately at 7:06 pm.

 

A motion to accept the 4/27/2006 minutes was made by George Ianson and seconded by Martin Fitzgerald.

Vote: Carried, 6-0

 

Puckette (42.12-1-18). Lakeshore Dr. TR1

Revised Application: The applicant, under the advisement of the Boards has moved their addition to the center of the existing house. New plans call for a 180 sq. ft. addition to the west side of the structure. A variance for sideline setback is no longer needed. However, 42 sq. feet of the proposed addition is within 50 feet of the shoreline. The purpose of the addition is to enlarge the kitchen and add a bathroom to the first floor of the residence.

 

The original proposal ended in a tie vote by the ZBA on 4/27/2006.

 

The Lake George waterkeeper has developed a plan for storm water.

 

Warren County Planning Board recommendation: no County impact.

 

George Ianson moved to approve the variance request.

There will be no undesirable change produced in the character of the neighborhood, neither will it be a detriment to nearby properties.

                The benefit sought by the applicant cannot be achieved by some other method feasible

            to the applicant other than an area variance.

            The variance is not substantial.

The variance will not have an adverse effect or negatively impact the physical or environmental conditions in the neighborhood or district.

            The alleged difficulty is not self created.

Bill Pittman seconded the motion.

Vote: Carried, 6-0

The applicant wishes to replace an existing house with a new log home. They are requesting a variance for the proposed increase to the deck area. Construction will be within 100 ft. of the shoreline. The proposed deck is further from the lake than the existing one.

 

Warren County Planning Board recommendation: no County impact with the condition that appropriate storm water and erosion control measures are taken during and after construction.

 

The LGPC has approved the storm water plan.

 

Martin Fitzgerald moved to approve the variance request.

There will be no undesirable change produced in the character of the neighborhood, neither will it be a detriment to nearby properties.

                The benefit sought by the applicant cannot be achieved by some other method feasible

            to the applicant other than an area variance.

            The variance is not substantial.

The variance will not have an adverse effect or negatively impact the physical or environmental conditions in the neighborhood or district.

            The alleged difficulty is not self created.

George Ianson seconded the motion.

Vote: Carried, 5-1

Ayes: Fitzgerald,  Ianson, King, Pittman, Goetsch

Nays: Doulin

At the Site Visit made on 5/10/2006, members of the Hague Planning Board recommended granting the variance request. 

 

 Tina King moved to approve the variance request with the condition the sun porch not be heated.

There will be no undesirable change produced in the character of the neighborhood, neither will it be a detriment to nearby properties.

                The benefit sought by the applicant cannot be achieved by some other method feasible

            to the applicant other than an area variance.

            The variance is not substantial.

The variance will not have an adverse effect or negatively impact the physical or environmental conditions in the neighborhood or district.

            The alleged difficulty is self created.

Mary Lou Doulin seconded the motion.

Vote, Carried, 6-0

 

Other business

Members of the Zoning Board of Appeals thanked Tina King for serving on the ZBA.

 

A motion to adjourn the meeting was heard at 7:24 pm from George Ianson. Bill Pittman seconded.
