Town of Hague Zoning Board of Appeals

Robert Goestch called the meeting to order at 7:02 pm.

 

 

Public Hearing

 

Hague Volunteer Fire Department, (25.5-1-16) West Hague Rd. OC-1

 

* Tina King recused herself from the Board for the Public Hearing.

 

The department is requesting retroactive approval of greater than 25% lot coverage and less than the minimum 25 ft. front line setback.

 

Robert Goetsch noted  the Public Hearing has been held open since August 25th by mutual agreement with the applicants.

 

Fire Department representative, John Breitenbach, addressed the Board. He informed them that all conditions for approval have been met:

                                    Macadam has been removed

                                    Storm water issues have been resolved

                                    The two lots have been merged

Mr. Breitenbach was agreeable to reviewing the area in the Spring to determine if storm water measures are sufficient. He assured the Board further steps would be taken at that time, if necessary.

 

Neighboring property owner Tina King addressed the Board to state she and her husband have no more objections as long as storm water measures are in place by early summer. Mrs. King submitted a written statement, dated 01/26/06,  for the record. She made reference to the Order on Consent, No. 012-12-005,  issued by the Lake George Park Commission which outlines the required work and the conditions regarding the suspended fine.  She further noted the LGPC and the LG Waterkeeper have stated they will be monitoring the situation.

 

With no further comments being heard, Robert Goestch closed the Public Hearing at 7:10 pm.

Regular Meeting

 

The regular monthly meeting of the Zoning Board of Appeals began at 7:10 pm.

 

One correction to the minutes was noted. The date on the title page should  read November 17, 2005 (not November 11). Motion to accept the amended minutes was heard from Martin Fitzgerald and seconded by George Ianson.

Vote: Approved, 6-0-1

Ayes: Goetsch, Doulin, Fitzgerald, Ianson, Mydlarz, Pittman

Nays: none

Abstentions: King

Cathy Clark stated her intention to inspect the leach field with a licensed engineer in the Spring. John Breitenbach had no objection to the spring inspection, assuming he is properly notified. He noted there is no evidence of a system failure.

 

Motion: George Ianson moved and Bill Pittman seconded the motion to approve the variance request based on the following:

There will be no undesirable effect on the character of the neighborhood and there will be no detriment to nearby properties with conditional approval.

            The benefit sought can not be achieved by any other feasible means.

            The request is substantial.

The variance will not have an adverse effect on the physical or environmental conditions  in the neighborhood with the conditions.

            The difficulty was self created.

 

The  variance will be approved with the following conditions:

            The existing temporary tarps will be removed

            Compliance with the LGPC conditions no later than July 15th, 2006

            Examination of the septic system to ensure no damage has resulted from the macadam

 

Vote: Approved, 6-0-1

Ayes: Goetsch, Doulin, Fitzgerald, Ianson, Mydlarz, Pittman

Abstentions: King

 

More, 43.5-2-35, Dock Rd. Hamlet/TR-1

Mr. More was in attendance and explained his desire to cover/replace an existing concrete patio and stairs with wooden decking and stairs. Construction would fall within 50 ft. from the lake. The existing 14 ft. shoreline setback will be reduced to12 ft. 

A Site Visit will be made to the property.

 

Motion: Martin Fitzgerald moved to schedule a Public Hearing for February 23rd. George Ianson seconded the motion.

Vote: Approved, 7-0

 

Harrison, (43.17-1-1), Lakeshore Dr., TR-1

The applicant wishes to erect a 4 ft. by 320 ft. fence on their property line. A fence is considered a structure, therefore a variance waiving the sideline setback requirements is needed. 

 

Motion: The application was deemed incomplete, on a motion heard from Tina King, based on the following:

                        The proper area variance section of the application must be completed.

The applicant should supply a scaled drawing reflecting the highway setback, property lines and adjacent neighbors’ homes.

 The motion was seconded by Lindsay Mydlarz.

Vote: Approved, 7-0

 

Other business:

Cathy Clark informed the Board of the Beaty’s (26.18-1-1.2) request to table further review.

 

The group reviewed the DOS conditions for variance approval. (letter to C. Clark dated 1/10/06)
