Public Hearing

Rose, 43.13-1-56, Robin Hood Rd. TR

 

Robert Goetsch called the Public Hearing to order at 7:00 pm.

 

No one in attendance spoke for or against the project.

 

Cathy Clark stated that she has not received any comments concerning the project.

 

The Nottingham Hill Homeowners Association have no objections to this retroactive variance request according to George Ianson.

 

The Public Hearing was closed at 7:05 pm. on a motion heard from Bruce Clark and seconded by Tina King.

Vote: Approved, 6-0

 

Regular Meeting

 

The regular meeting was immediately called to order by Robert Goetsch.

 

The minutes from August 25, 2005 were approved on a motion made by Bruce Clark and seconded by George Ianson.

Vote: Approved, 6-0

 

Hague Volunteer Fire Department, (25.5-1-16) West Hague Rd. OC-1

Tabled until October 20th at the request of the applicants.

 

Rose, 43.13-1-56, Robin Hood Rd. TR-1

 Zoning Board members reviewed the circumstances concerning the construction of the deck. Although Mr. Rose repeatedly reapplied to Warren County for a building permit for his home, he did not realize he could not add the deck, located 17 ft. from the property line. 

The Planning Board visited the site on 9/9/05 and recommended approval.

 

Cathy Clark read a letter from former ZEO Graham Bailey, dated 7/26/05, notifying Mr. Rose of the violation.

 

Tina King moved to approve the retroactive variance request based on the following:

            The Planning Board recommends it

            The deck is consistent with the neighborhood

            No letters against the variance request have been received from the neighbors

            It appears the applicant was unaware of the laws that were required at the time

In addition she noted:

            The change will not have an undesirable effect on the neighborhood.

            The benefit sought could be achieved if the applicant removed the deck.

            The request is not substantial.

The variance will not have an adverse effect on the physical or environmental conditions  in the neighborhood.

            The difficulty was self created but unintentionally.

 

Bill Pittman seconded the motion.

Vote: Approved 4-1-1   Ayes: Doulin, Ianson, King, Pittman

                                       No: Clark

                                       Abstention: Goetsch

 

George Ianson moved to close the meeting at 7:25 pm. Tina King seconded.

Vote: Approved, 6-0
