Public Hearing
Hague Volunteer Fire Department, (25.5-1-16),
The department is requesting retroactive approval for greater than 20% lot coverage and less than the 25 ft. minimum setback from the front property line.
The following letters were read by Cathy Clark:
Tina King read a letter from Lt. Joseph Schneider, Director of Law Enforcement for the
Lake George Park Commission addressed to Dan King,
8/25/05, noting an outstanding stormwater regulation
violation by the Fire Department.
Tina King, neighboring property owner, expressed concerns about
the stormwater runoff flowing onto her lot and
requested the problem be addressed in a timely fashion. She and her husband
have no objections to the building variance requests.
John Breitenbach, Jr., HVFD representative, explained the three structures were designed to accommodate fund-raising events, and were originally intended for temporary use. The permanent structures continue to provide shelter for those same events. He assured those in attendance the Fire Department will continue to work with the LGPC to resolve the legal issues surrounding the stormwater runoff.
The Public Hearing was closed at 7:20 pm. on a motion heard from Bruce Clark and seconded by Tina King.
Vote: Approved, 7-0
Regular Meeting
Minutes from the July meeting were approved as written. Motion by Bruce Clark, second by Martin Fitzgerald.

Dougherty, 43.13-1-36,
The applicant has requested the matter be tabled until it has been reviewed by the Cape Cod Village Homeowners Association.

Citing section 150-28 of the Zoning Ordinance, Bruce Clark made a motion to deny the variance requests because the lot line change has not been reviewed and approved by the Planning Board. There was no second to the motion.
According to Cathy Clark, as a matter of procedure, the Planning Board should have been given the opportunity to review the application.
Bruce Clark offered a motion to table the matter until the Planning Board has reviewed the application. Mary Lou Doulin seconded the motion.
Vote: Approved, 6-0 (Tina King reused from discussion and vote)
Because the Public Hearing has been held, John Breitenbach agreed to waive any time constraints surrounding a decision. He will continue to work with the appropriate agencies to resolve the stormwater runoff issues.
* Tina King resumed her position on the Board.
Rose, (43.13-1-56),
The applicant is requesting retroactive approval for a deck constructed without a Zoning Compliance Certificate. Cathy Clark provided the group with pictures she took while visiting the site. The deck and stairway are located 17 ft. from the front or roadside of the property, less than the required 25 ft.
Bruce Clark moved to schedule a Public Hearing for the next
meeting.
Vote: Approved, 7-0
At 7:35 pm, a motion to adjourn the meeting was heard from Bruce Clark and seconded by Martin Fitzgerald.
