Zoning Board of Appeals

July 28, 2005

Robert Goetsch called the meeting to order at 7:01 pm.

 

The minutes from the previous meeting on May 26, 2005 were amended as follows:

              page 2, Phelps review - eliminate item #4 

A motion to accept the minutes as amended was made by Bruce Clark and seconded by Bill Pittman.

Vote: Approved, 6-0

 

Reingold, (43.13-1-5) Abenakis Rd., TR-1

Mr. Reingold appeared before the board to explain the modifications he has made to his house plans. These changes, described his letter to the town dated July 7, 2005, will reduce the footprint of the building, making it less non-conforming.

Martin Fitzgerald made the following motion: The ZBA has no problem with changing the footprint of the planned building. Robert Goetsch seconded the motion.

Vote: Approved, 6-0

           

Hague Volunteer Fire Department, (25.4-1-16), West Hague Rd.  OC-1                     

The department is requesting retroactive approval for a variance for the following:

            - greater than 20% lot coverage

            - less than the required 25 ft. front setback

Bruce Clark made note of the department’s intention to join two lots, thus increasing the total lot size. He questioned whether Planning Board review is necessary.

John Breitenbach, representing  the Fire Department, stated his opinion that such review is not required, but agreed to provide documentation of the Fire Department’s intention for the final result to be one lot, with one tax map ID number. The board discussed adding this as a condition if the variance is approved.

 

The group made note of the problems in the area associated with storm water runoff.

Mr. Breitenbach explained that many of the runoff issues in the area are not caused by the department, but plans call for removing the existing blacktop under the pavilion which will facilitate drainage.

Mr. Breitenbach reviewed the history related to the construction of the transmission tower. He explained  the project was a joint effort between Town, County and Fire Department officials. The failure of Warren County to obtain a permit was inadvertent.

 

A motion to schedule a Public Hearing for the following month was made by Bruce Clark and seconded by Martin Fitzgerald.

Vote: Approved, 6-0

 

Other business

Graham Bailey, leaving his post as ZEO, stated he has enjoyed working with the group. The Board thanked him for his hard work and wished him well.

 

Motion to adjourn at 7:20 pm was made by Bruce Clark. Martin Fitzgerald seconded.

Vote: Approved, 6-0.
