Zoning Board of Appeals

Robert Goetsch called the meeting to order at 7:03 pm.

 

A motion to accept the minutes from the March 24, 2005 meeting was made by George Ianson, and seconded by Bruce Clark.

Vote: Approved, 5-0-1. Mary Lou Doulin abstained.

 

Dougherty, (43.13-1-36) Cranberry Dr., TR-1

Graham Bailey informed the board of the applicants’ request to table their application until further notice while their project is reviewed by the Cape Cod Association.

Motion: At 7:06 pm. Tina King moved to close the Public Hearing held open from the previous meeting.  Mary Lou Doulin seconded.

Vote: Approved, 6-0

 

Reingold, (43.13-1-5) Abenakis Rd., TR-1

Tina King recused herself from the discussion.

 

Mr. Reingold appeared before the board to request permission to demolish, and rebuild, rather than move the outbuilding located on his property. In addition, should conditions prohibit altering the main residence, he would like approval to rebuild it, using new materials. When complete, the resulting structure will be identical to the one previously approved by the ZBA, (letter from Mr. Reingold, dated 4/20/05, included in file).

 

Motion: George Ianson moved to accept the request for construction changes as required, for new materials only, that result in identical structures as previously approved, contingent upon review by the own attorney. Bruce Clark seconded the motion.

Vote: Approved, 5-0-1, Tina King abstained.

           

Phelps, (43.5-2-38), Dock Rd., Hamlet

Mr. Phelps explained the proposal to add a second story to a preexisting, nonconforming structure in order to relocate the bedrooms upstairs. The residence is located within 50 ft. of the shoreline.

The height of the existing and proposed structure must be confirmed. Measurements will be taken from the lowest to the highest points on the building.          

 

Plans call for a false ceiling, creating an attic space above. At this writing, attics are considered additional living space. If possible structurally, the Phelps will not include the false ceiling, (resulting in an attic) thus limiting the amount of increased living space and the need for that variance.

 

Although construction will follow the existing footprint of the building, a side yard setback variance is needed because the upward expansion is within the 10 ft. limit.

 


Lot coverage will remain the same. Graham Bailey will calculate the amount, not to  include the attached boathouse. 

 

Motion: Tina King moved to find the application complete, assuming a revised height measurement and land coverage percentage are included on the application by the next meeting. George Ianson seconded.

Vote: Approved, 6-0

 

A variance recommendation will be sought from the Planning Board.                 

 

Other business

Dept. of State/APA training in Hague, May 4th.

 

Discussion commenced regarding a fence/barrier constructed on top of a boathouse located on Rt. 9N.  Although the original structure has been removed, a variance has been requested from the LGPC.
