SEWER PROPOSED CHANGES

PUBIC HEARING

JUNE 22, 2009

Members present:  Supervisor Belden, E. Frasier, R. Meola, and M. Martucci.

Absent:  R. Gladu.

 

Supervisor Belden opened the meeting at 4:00 pm.

 

The following were complaints received on EDU assessments for Sewer District #1 & #2.

 

1.  Forest Bay Property Owners (Beach lot): Tax Map 26.10-1-1 

 

     Three streams and wetlands on the property limits the development of the lot.

            Assessed for 20% EDU

            Request:  non-buildable

 

Boards decision:  Motion by Supervisor Belden, seconded by M. Martucci that tax map # 26.10-1-1 will be assessed 0 non-buildable with the condition that the lot will always stay with the Forest Bay Property Owners and never be built on.  The Forest Bay Property Owners will have until the second week of July to present the Town Board with a letter.  All voting yes.  Motion carried.

 

2.  Caffrey & Flowers representing John & Linda Toner:

 

The Town Boards decision of June 9, 2009 for Tax Map # 26.6-1-18 & # 26.6-1-26           (Fisher Act properties).  Forest Bay Property Owners will be charged a 20% EDU for both parcels.  Buildable lots.

 

3.  Eleanor Faber:  77 Forest Bay Rd. South.  Tax Map # 26.10-1.12

            Assessed for 2 EDU’s             

            Request: 1 EDU – Single Family Dwelling

 

Boards decision:  Motion by R. Meola, seconded by E. Frasier to reduce to 1 ˝ edus.  Single Family Dwelling with Bunk house.  All voting yes.  Motion carried.

 

 

4.  Bruce Rust:  9100 Lakeshore Drive.  Tax Map # 43.5-1-33

            Assessed for 2 EDU’s

            Request:  1 EDU – Seasonal use, low use of building.  Residential & Gift Shop

 

Boards Decision:  Motion by R. Meola, seconded by E. Frasier that the assigned EDU for tax map # 43.5-1-33 will remain the same.  Single Family Dwelling & Single Commercial Enterprise.  All voting yes.  Motion carried.

 

 

5.  Chris Mayer: Forest Bay Rd., South.  Tax Map # 26.10-1-13

            Assessed:  1 ˝ EDU’s

            Request:  1 EDU – Single Family Dwelling

 

Boards decision:  Motion by R. Meola, seconded by E. Frasier to reduce Tax Map #26.10-1-13 to 1 EDU- Single Family Dwelling.  All voting yes.  Motion carried.

 

 

6.  John Goehrig:  8853 Lakeshore Dr.  Tax Map # 43.13-1-63

            Assessed:  2 EDU

            Request:  1 EDU – Single Family Dwelling

 

Boards decision:  Motion by Supervisor Belden, seconded by R. Meola to reduce tax map # 43.13-1-63 to 1 EDU.  Single Family Dwelling.  All voting yes.  Motion carried.

            Assessed:  2 EDU’s

            Request:  0 – Two bathrooms.  Seasonal use

 

Boards decision:  Motion by M. Martucci, seconded by R. Meola to reduce Tax Map # 42.12-1-21.1 to 1 EDU – Marina docking only.  All voting yes.  Motion carried.

 

 

8.  Northern Lake George Yacht Club:  40 Friends Point

            Assessed:  3 EDUS

            Request:  2 EDUS

 

Boards Decision:  Motion by M. Martucci, seconded by R. Meola to reduced Tax Map # 26.14-1-3 to 2 EDU’s.  Marina docking only.  All voting yes.  Motion carried.

 

9.  Patchett Family Partnership: 9117 Lakeshore Dr.

            Assessed:  23 ˝ EDU’s

            Request:  16 EDU’s – ˝ edu per rental. The new Sewer User Schedule equates a   tourist housekeeping accommodation to a Single Family Dwelling.  

 

 

The property EDU’s were increased when the Sewer User Schedule changed.  Mr. Patchett stressed that commercial is different from residential homes.  These are commercial rental units, not private homes.

 

Boards decision:  The Town Board will review the Trout House Village fee’s.

 

 

10.  Hague Group LLC:  9848 Graphite Mtn. Rd., Tax Map #43.5-2-14.

Request reduction from 6 to 5 EDUs.  The two offices have 1 sink, 1 toilet, and only 3 employees per office. 

Offices with 4 employees or fewer ˝ EDU charge.

Reduction from 6 EDUs to 5 EDUs.

 

Motion by R. Meola, seconded by E. Frasier to close the meeting at 4:30 pm.  All voting yes.  Motion carried.

 

Motion by R. Meola, seconded by E. Frasier to open the public hearing at 4:30 pm.

Tax Map #12.18-1-31 violations.  All voting yes.  Motion carried.

 

The Town Clerk read the following notice of publication in post star on June 16, 2009.

 

PLEASE TAKE NOTICE that the Town Board of the Town of Hague serving as the Local Board of Health will conduct a public hearing on Monday, June 22, 2009 beginning at 4:30 pm at the Hague Community Center, 9793 Graphite Mt. Rd., Hague, NY to consider the following violation of Articles 76 Unsafe Building sections 76-4 A. B. C. E. H. I. and Article 132 Sewer Sections 132-5 Prohibited acts. C & 132-12 Continuation of preexisting systems of the Town of Hague. The property tax map

#12.18-1-31.

At such public hearing all persons will be given the opportunity to be heard.

 

Mr. Podeswa and Mr. Kent reported on the status of the septic problem.  They will get estimates for a septic system with a 1500 gallon tank with a leech.  The violation on the unsafe building will also be addressed. 

Motion by Supervisor Belden, seconded by E. Frasier to close public hearing at 5:30 pm.  All voting yes.  Motion carried.

 

Motion by R. Meola, seconded by E. Frasier open the meeting at 5:31 pm.  All voting yes.  Motion carried.

 

Motion by Supervisor Belden, seconded by E. Frasier to give the property owners of Tax Map #12.18-1-31 a variance to install a new septic by August 1, 2009 and to have the unsafe building renovated or demolished. No one is allowed to stay on the property until these issues are resolved.  AYES:  Supervisor Belden, R. Meola, E. Frasier, and M. Martucci.  Motion carried.
