Supervisor Belden opened the meeting at 5:30 pm.

Members present:  Supervisor Belden, E. Frasier, R. Gladu, R. Meola and M. Martucci.

Also present:  Attorney Viscardi

 

Mr. Tatich, Elan Planners gave a presentation on the Hague Memorial Veterans Park. 

The building will be located on the northwest corner of the property.  There will be a large memorial bell and stone memorials listing the names of Hague Veterans.   Memorabilia will be located inside the building.

 

The next phase of the project will be to get construction drawings and site plan approval.

 

Motion by E. Frasier, seconded by M. Martucci to close meeting at 6:00 pm.  All voting yes.  Motion carried.

 

Supervisor Belden opened the Audit meeting at 6:00 pm.

 

The Board reviewed the bills.

Welcome Guests/Privilege of the floor:  Mr. John Goehrig spoke against his increase to his Sewer Rent.  He should be charged as a Single Family Dwelling.  The Board will review and make their recommendations at the special Town Board Meeting scheduled for June 22, 2009.

 

There was a complaint in regards to the Town Parking lot next to Junipers and the Baptist Church.  During the late evenings there have been numerous times that people have been seen urinating in the parking lot, open container, and groups of people smoking marijuana.  Supervisor Belden will contact the State Police and Sheriff’s Department to make them aware of the situation.

 

Chris Navitsky, Lake George Water keeper would like the Board to hold off passage of the proposed resolution opposing the LGPC Stream Corridor revisions.  There are parts of the resolution that are not correct.  The Commission is in the process of setting up public hearings on the new Stream Corridor revisions.  The Board would like the Lake George Park commission to address the towns with their proposals prior to their passage.

 

Councilman Meola introduced Donna Wotton, a professional event planner who has volunteered to work with the committee on the Oktoberfest.  The event will help to promote business in the area.  This event was approved for 9/26, but due to the 12th Annual Republican Party Oktoberfest fun raiser scheduled for the same day, the committee is exploring possibly changing the date of the event. 

 

Motion by R. Meola, seconded by R. Gladu to change time of the promotional Oktober Fest to be held at the Hague Park from 12:00 noon to 6:00 pm.  All voting yes.  Motion carried.

 

Gene Moran questioned why Casella Waste charges for recyclables if you do not bring up a bag of garbage.  Councilman Gladu will review this with Casella Waste.

 

Discussion of Bills:  Motion by M. Martucci, seconded by E. Frasier to pay General Highway & Sewer claims audited at tonight’s meeting.  All voting yes.  Motion carried.

 

Motion by R. Meola, seconded by M. Martucci to approve minutes of May 12 & May 19, 2009 as printed.  All voting yes.  Motion carried.

 

Regular Committee Report:

 

  1.  Assessor & Justice (Gladu/Meola): Councilman Gladu reported that the Board of Assessment Review met on May 26, 2009.  There were 6 stipulations agreed on.  One litigation.  The final roll will be completed July 1, 2009.  To date are equalization rate is 70.4.

 

Councilman Gladu addressed the complaints in regards to the nuisance problem of dogs barking on the New Hague Road.

 

After a long discussion it was motioned by R. Gladu, seconded by M. Martucci to authorize Attorney Viscardi to write a letter to the property owner of the dogs.  They need to stop the nuisance due to the barking problem.  They will have until July 14, 2009 to resolve the problem.  The next step will be a summons of complaint. Councilman Meola stated that there is a motion on the books from 6/10/08 directing the Town Attorney to start legal proceedings.   AYES:  Supervisor Belden, R. Gladu, M. Martucci, R. Meola, and E. Frasier.  Motion carried.

 

  2.  Buildings & Grounds/Enhancement (Martucci/Frasier):   Councilman Martucci reported that the deck is completed in the front of the Community Center.  The entrance to the vault and the Assessors office next door needs to be repaired.  The recommendations are to jack up that side of the building.  Pricing for the kitchen is underway.  RFP’s will be ready for the July meeting for the east ramp.

 

A letter of thanks will be sent to the Carillon Garden Club for a great job of adding plants under the entrance signs to Hague.

 

  3.  Finance & Insurance (Frasier/Martucci):  Councilwoman Frasier reported that Mr. Richard Dinolfo, CPA has completed the accounting of financial operations for the Town of Hague.  The cost of the audit was $6,600.00.  There were a couple of recommendations stated.  Councilman Meola feels that the report was very vague.  There were concerns that he asked to be addressed, that never were.  It’s customary for the examiner to meet with the Board to discuss the report prior to its release.

 

Councilwoman Frasier said that he was asked to audit the books for 2008, not for prior years.

 

Councilman Meola felt that his concerns while occurring in prior years should have been reviewed by Mr. Dinolfo and should also be of concern to the Town Board.

 

Councilwoman Frasier will ask Mr. Richard Dinolfo, CPA to meet with the Board to review his report.

 

  4.  Fire Department (Gladu/Martucci):  Councilman Martucci reported that the Fire Boat is in full service.  The prior problem was that the water pump was seized, due to not being flushed out after being in salt water.  They will now be taking special training classes on fighting fires of hybrid cars.

 

  5.  Highway (Martucci/Gladu):  The County specs for the new truck will be here tomorrow and we will review and go out to bid.  Town Clean Up Day is June 19, 2009. 

           

   6.  Museum & Historian (Frasier/Martucci):  Councilwoman Frasier reported that the Historical Society will hold a presentation on the “Sexton Sisters” June 23rd at 7 pm.  Hague Community Center.

 

  7.  Personnel (Frasier/Gladu):  No Report

 

  8.  Planning/Zoning/Stormwater (Gladu/Meola):     Councilman Gladu reported that the Planning Board has the exclusive jurisdiction over site plan reviews.

The Board made modification to 5-7-09 approval for the Firehouse restaurant, review of a minor subdivision, & approved one modification to an existing use to include a restaurant with wine and beer.

The Board approved a fence application. APA approved.

 

·         Zoning Violations:

      No applications have been received.  Applicant has removed web-site                            advertisement and will remove second kitchen, as state by his attorney

      Local DOH Septic Violation.  Letter attached.

 

·         LGPC proposed Stream Corridor Regulation: The LGPC has released their EIS on the revised Stream Corridor Regulations.  Modification were based on comments received at the recent hearings. Email attachment to the the board.  Grant money would be available to the Townfor stream restoration, if approved, see page 82 of Appendix A.

 

·         Request permission to have June 24, 2009 off.

 

·         APA Proposed Local Government Planning Grant Attached.

 

Motion R. Meola, seconded by M. Martucci to give the ZEO permission to close the office on June 24, 2009.  All voting yes.  Motion carried.

 

  9.  Recreation Promotion & Youth (Meola/Martucci): Motion R. Meola, seconded by M. Martucci to sponsor the Silver Bay YMCA Children’s program and the Summer Music Program for 2009.  All voting yes.  Motion carried.

                                               

10.  Sewer Dist. #1 & #2 (Belden/Frasier):  Supervisor Belden reported that District #2 is going well.  The roads cannot be paved until the testing is completed.  They were sent bad gaskets which have caused the manholes to leak.

 

11.  Town Park (Meola/Martucci):  Councilman Meola thanked Phil Swanson for the signs that he did for the Town.  He also donated free signs for the lifeguard area.  The geese are still a problem. A staff member from Raybrook will be down to the park to help trap geese.  Oiling of the eggs in March/April can help prevent the eggs from hatching. 

 

12.  Transfer Station (Gladu/Meola): Councilman Gladu will contact Casella Waste on the possibility of no charge for recyclables if you have no garbage.

NEW BUSINESS:

1. RESOLUTION #63 of 2009

SUPPORT FOR THE WARREN COUNTY FISH HATCHERY

Resolution introduced by M. Martucci, seconded by R. Gladu.

 

WHEREAS, Warren County Fish Hatchery, operated by Warren County and established by the State of New York in 1914, is a source of significant revenue to the County of Warren through people fishing, eating in local restaurants, staying at local lodging facilities and buying bait and equipment through the multiple towns within the County, and

 

WHEREAS, the Fish Hatchery is one of the best learning tools that can be provided to schools teaching them about the operation of the hatcheries, significance of stocking the various waterways and benefits to nature and has had numerous site visits by schools and educational institutions, and

 

WHEREAS, the Warren County Fish Hatchery provides stock to all local streams, rivers, ponds and lakes for all municipalities throughout Warren County, keeping our local waters from the growth of negative organism and creation of polluted sites through out the county, with Warren County Soil and Water Conservation holding an “Environthon” event each year at the Warrensburg Fish Hatchery which teaches school students throughout the county about environmental issues, and

 

WHEREAS, another major use of the Warren County Fish Hatchery facilities is for sports activities, company, organization and family events which take place annually,

 

NOW, THEREFORE, BE IT RESOLVED, the Town Board of the Town of Hague  urges the Warren County Board of Supervisors to continue to fund operations to the Warren County Fish Hatchery, and,

 

BE IT FURTHER RESOLVED copies of this resolution be sent to the Warren County Board of Supervisors, Warren County Towns, Senator Elizabeth Little, and Assembly Member Teresa Sayward.

NOW THERE FORE BE IT RESOLVED that the Town Board of the Town of Hague serving as the Local Board of Health will conduct a public hearing on Monday, June 22, 2009 beginning at 4:30 pm at the Hague Community Center, 9793 Graphite Mt. Rd., Hague, NY to consider the following violation of Articles 76 Unsafe Building sections 76-4 A. B. C. E. H. I. and Article 132 Sewer Sections 132-5 Prohibited acts. C & 132-12 Continuation of preexisting systems of the Town of Hague. The property tax map

#12.18-1-31.

At such public hearing all persons will be given the opportunity to be heard.

AYES:  Supervisor Belden, R. Meola, R. Gladu, M. Martucci, and E. Frasier. 

NAYS:  None.

ABSENT:  None.

3.  Motion by R. Meola, seconded by E. Frasier to authorize Supervisor Belden to sign the amended agreement for use of County Motor Fuel System- increase in per gallon maintenance fee from $.06 per gallon of fuel to $0.16 per gallon of fuel.  Effective 1/1/2010. AYES:  Supervisor Belden, R. Meola, E. Frasier, and M. Martucci Nays: R. Gladu.

Motion carried.

 

4.  Motion by R. Gladu, seconded by E. Frasier to authorize payment of $1,250.00 to Warren County to retain the GIS Program.  AYES:  Supervisor Belden, R. Meola, R. Gladu, M. Martucci, and E. Frasier.  Motion carried.   

 

5.  Motion by M. Martucci, seconded by R. Meola to table Resolution opposing the LGPC’s decision on revised stream protection. 

 

Councilwoman Frasier asked when are we as citizens going to say stop all the new rules and regulations.  When will the time come when we feel like we are losing our rights as Americans.  Dan agreed with Edna there is too many groups creating new laws constantly.  The Board would like the LGPC to set up joint meetings with neighboring towns to inform them of their proposed regulations prior to them making a decision.

 

 

6.  RESOLUTION #64 OF 2009

 

Town of Hague is opposed to NYS DEC

Proposed regulations to ban the use of

Burn Barrels

 

Resolution introduced by R. Meola, seconded by M. Martucci

 

RESOLVED,    the Hague Town Board respectfully opposes the proposed regulations to ban the use of burn barrels.  The Board agrees that open burning of residential wastes such as garbage, plastics, and petroleum or rubber based products should not be allowed. NYS DEC and the Municipalities should educate the public on how to burn properly and allow the restricted use of the burn barrels.

RESOLVED,  that the Town Board amend the Town Budget for fiscal year 2009 by

Decreasing Fund Balance in General Fund A00909 and increasing appropriations A00 960 A00-1320.400 by $6600 for Audit budgeted and started in 2008 and completed in 2009.

Councilman Meola mentioned that the article in the Lake George Mirror on the Senior Citizens failed to mention that the Town has contributed $21,500.00 from 2005-2009 to the Memorial Day Parade.
