SPECIAL MEETING WITH THE ATTORNEY FOR THE TOWN
APRIL 6, 2009

Members present: Supervisor Belden, E. Frasier, R. Meola, R. Gladu, and M. Martucci.
Also present: Dominick Viscardi, Attorney for the Town
Supervisor Belden opened the special meeting at 5:00 pm. The Board and the Attorney reviewed the proposed Sewer User schedule. The Attorney for the Town argued that Commercial cabins should remain at 1 EDU. Councilman Meola proposed a ¾ EDU thus increasing some from the present ½ EDU and lowering some from the present one.
Motion by Supervisor Belden, seconded by E. Frasier to close the special meeting at 6:25 pm. All voting yes. Motion carried.

Supervisor Belden opened the public hearing at 6:30 pm.
The Town Clerk read notice of publication in the post star, March 26, 2009.
The public hearing is scheduled to here comments on the allocation of EDU’s (equivalent dwelling units) of Sewer District #1 & #2.
Public Comment:
Lawrence Schwartz (19 Pine Cove Dr.): House is only used 6 months out of the year. Believes ½ edu would be a fair assessment of sewer.
Katherine Allen, President of Friends Point Assoc.: Tax Map #26.10-1-40 is the tennis courts for the Association should be assessed 0.
Judy Stock: The construction company has been doing work on private properties, will the company clean up the property once construction is completed. Supervisor Belden said that this will be done.
John Barth Jr. (Friends Point): The house and the bunkhouse are seasonal and used less than 6 months out of the year. The stove has been removed from the small cottage.
Philip A. Smith, President Forest Bay Property Owners Association: Three parcels are being assessed as buildable lots. Mary O’Dell, APA will be assessing the property to determine if it is wet lands.
Supervisor Belden explained that if it is determined that the property is deemed as wet lands a complaint form must be filed before July 1.
Mark Straubel (34 Spring Lane): Tax Map #26.10-1-20. The home & bunk house are seasonal.
Robert Patchett (Trout House Village): One Family Dwelling and a Tourism Housekeeping Cottage should not be classified as the same use. Commercial Assessment is different; we pay Occupancy Tax, Sales Tax, Department of Health fees, Commercial Insurance. It is a business, not a home. Change from ½ edu per cabin to 1 edu has a huge impact on business.
Rudy Meola: The proposed new Sewer User Schedule list the following: Cabins used for recreational purposes as a commercial business that is rented out for seasonal or short transient occupancy would be charged ¾ edu instead of 1 edu.
Judge Viscardi: As stated in Resolution 60 of 2008, all costs for the proposed district are to be assessed on a benefit basis to the lots and parcels in the district, in proportion as near as may be to the benefit each derives therefrom.

Lee Masquelier, Bob Patchett, Phillip White, Richard & Christine Oliver, Caffrey & Flower Attorneys.
Motion by R. Meola, seconded by E. Frasier to close the public hearing at 7:10 pm. All voting yes. Motion carried.
Supervisor Belden opened the special meeting at 7:10 pm.
RESOLUTION #55 OF 2009
TOWN OF HAGUE SEWER DISTRICT #2
Resolution introduced by E. Frasier, seconded by M. Martucci.
WHEREAS, the following is the manner in which the EDU’s for Sewer District No. 2 are allocated to the property owners by the Town Board with reference to capital cost and operation and maintenance and
WHEREAS, the definition of an EDU of a sewer system is as follows: An EDU is an equivalent dwelling unit, which means a system user equivalent to a typical single-family residence which serves as a means of proportioning system usage and cost and
WHEREAS, the properties of the district break into the following categories: single-family homes, seasonal residences, multiple family residences, vacant land (which land is a buildable lot), vacant land (which land is not a buildable lot), parcels containing two structures, one of which is not an equivalent dwelling unit, one commercial structure containing family residence and four rooms for rentals, and a parcel which functions as a marina with banquet facilities, Now therefore be it resolved that
EDU’s are assigned to each parcel as follows:
a) Single-family homes and seasons residences - 1 EDU for operation and maintenance and 1 EDU for capital cost.
b) Multiple family residences - 2 EDU’s for operation and maintenance and 2 EDU’s for capital cost.
c) Vacant land (which land is a buildable lot) - .2 EDU’s for operation and maintenance and 1 EDU for capital cost.
d) Parcels containing two (2) structures in which one is not an equivalent dwelling unit - 1.5 EDU’s for operation and maintenance and 1 EDU for capital cost.
e) Vacant land (which land is not a buildable lot) - no charge.
f) Bed and breakfast parcel, which has four rooms to rent, is charged as follows: The owners of the premises maintain a home at the location and are charged 1 EDU for operation and maintenance and 1 EDU for capital cost. EDU’s for the four rooms for operation and maintenance are charged .5 EDU each, which adds up to an additional 2 EDU’s, for a total of 3 for the operation and maintenance cost.
g) The marina with banquet facilities is assigned 3 EDU’s for operation and maintenance (2 EDU’s for the marina and 1 EDU for the banquet facilities) and 1 EDU for capital cost.
Any changes to any parcel in the future can be adjusted upon a factual finding on a case-by-case basis. The present schedule of allocations addresses factually how the district is comprised presently. All voting yes. Motion carried.

The Town will waive all connection fees until January 2012.
Motion by R. Meola, seconded by Supervisor Belden to hire Bob Rafferty to help Tim Costello pull a pump on Dodd Hill Road. He will be hired as a temporary employee.
AYES: Supervisor Belden, R. Meola
NAYS: R. Gladu, E. Frasier and M. Martucci.
Motion denied.
The Board would like the Supervisor to check with the Highway Department first to see if anyone is available to help Tim pull the pump. If they are not available then the Supervisor is authorized to hire someone to help Tim.
Motion by R. Meola, seconded by e. Frasier to adjourn meeting at 7:30 pm. All voting yes. Motion carried.
