SPECIAL TOWN BOARD MEETING

JUNE 4, 2008

4:00 PM

 

Members present:  Supervisor Belden, E. Frasier, R. Gladu, R. Meola, and M. Martucci.

 

Motion by R. Gladu, seconded by E. Frasier to open the meeting at 4:00 pm.  All voting yes.  Motion carried.

 

Motion by R. Meola, seconded by R. Gladu to go into executive session to discuss Highway Personnel at 4:01 pm.  All voting yes.  Motion carried.

 

Motion by M. Martucci, seconded by E. Frasier to return to open session at 4:30 pm.  All voting yes.  Motion carried.

 

Judge Viscardi and Linda Benway/ ACO/DCO were present to discuss the proposed Local Law on Dog Control and the complaints on barking dogs on New Hague Road.

 

Linda Benway has received approximately 20 more complaint tickets in regards to barking dogs on New Hague Road.  The Board directed her to call the police and have them delivered to the owner.

 

The Board asked the Attorney for his recommendation on how to handle this issue.

 

Attorney Viscardi explained that the procedures of issuance of tickets will continue, with a local court hearing, and fine.

 

The Board if they wish could file an action for nuisance.

 

The Board asked Linda if SPCA as been contacted.  Linda stated no.

Motion by E. Frasier, seconded by Supervisor Belden authorizing Linda Benway, ACO/DCO to contact SPCA and have them review the situation on New Hague Road.  AYES:  Supervisor Belden, E. Frasier, R. Meola, R. Gladu, and M. Martucci.  Motion carried.

 

R. Meola stated that the problem was not on how well the dogs were treated but on the amount of noise that they make.  The SPCA will deal with the treatment of the dogs but not the nuisance problem.  The noise problem can be handled by filing an action for nuisance. 

 

Linda was concerned that the proposed local law is not any stronger than what was on the books now.

 

Attorney Viscardi explained that the proposed Local Law on Dogs gives a much stronger burden of proof.

 

ZEO Cathy Clark presented documents to the Town Board this afternoon.  The parties involved, Hacker Craft & Lamberts Forts are both in agreement that an 8 foot fence needs to be installed between their property lines for safety reasons.

 

Motion by R. Meola, seconded by R. Gladu that the Town Board acting as the Board of Health support the recommendations of the ZEO to immediately require the construction of a “Hard Fence,” up to 8 feet tall on the southern property line running the full length of the property line.  AYES:  Supervisor Belden, R. Meola, R. Gladu, E. Frasier, and M. Martucci.  Motion carried.

 

Motion by R. Meola, seconded by E. Frasier to go into executive session to discuss a personnel issue at 5:30 pm.  All voting yes.  Motion carried.

 

Motion by E. Frasier, seconded by R. Gladu to return to open meeting at 5:50 pm.  All voting yes.  Motion carried.

 

The Committee will review the files of the Assessor and discuss a flexible working schedule.

 

Motion by E. Frasier, seconded by R. Gladu to adjourn meeting at 5:55 pm.  All voting yes.  Motion carried.
