Supervisor Belden opened the audit meeting at 6:00 pm.
The Board reviewed and discussed the monthly bills.
Regular meeting opened by Supervisor Belden at 6:30 pm.
Welcome Guests/Privilege of the floor: Rudy Meola questioned the Board on the 3 proposals that were received and voted on at the last regular meeting. The Board violated section 103 of the General Municipal Law. If the work or item requested cost more than $10,000.00 sealed bids should be requested & received. The Board also did not accept low bids.
Supervisor Belden explained that we have been trying to get this project completed for years. The Board reviewed the proposals quickly and did not take all factors into consideration. The material has been paid for by the Town of Hague.
Councilwoman Frasier explained that the material has already been purchased if we went back out to bid we would be under the threshold of asking for sealed bids. The Board made a mistake and hopefully this will not happen again.
Motion by R. Gladu, seconded by A. Steitz to resubmit statement of requirements and rescind the motion to hire David Dunn to install the tile in the Community Center and follow General Municipal Law 103.
AYES: R. Gladu.

Motion denied.
David Dunn will be installing the tile from May 10-13 of 2007.
Motion by E. Frasier, seconded by A. Steitz to draw warrant on Supervisor to pay bills audited at tonight’s meeting in the amount of $31,738.04. AYES: All voting yes. Motion carried.
Motion to accept minutes of April 10th & April 17 of 2007 as printed. All voting yes. Motion carried.
Regular Committee Report:
1. Assessor & Justice (Gladu/LaPointe): Councilman Gladu reported that the Tentative Tax Roll is out. The equalization rate went from 79.5 down to 70.5. The Assessor will be available on Saturday May 19, 2007 to answer any questions in regards to assessment. Grievance Day is scheduled for May 22, 2007.

RESOLUTION CREATING POSITION OF BOARD OF ASSESSMENT REVIEW- ALTERNATE MEMBER
Resolution introduced by R. Gladu, and seconded by A. Steitz.
WHEREAS, the Town of Hague Town Board desires to provide the taxpayers of Hague with a board of assessment Review that will be assured of having a quorum for its regular scheduled meeting, and
WHEREAS, some taxpayers may travel many hours to attend the regularly scheduled meeting, and
WHEREAS, in the past, members of the Board of Assessment Review have been absent due to illness and various other reasons,
NOW THEREFORE BE IT RESOLVED, that the position of Board of Assessment Review – Alternate Member is hereby created.
DULY ADOPTED BY THE FOLLOWING VOTE:

Motion by R. Gladu, seconded by T. LaPointe to appoint Raymond Mury as Alternate Member to the Board of Assessment Review and the Board will pay mileage for training at Warren County. All voting yes. Motion carried.
2. Buildings & Grounds (LaPointe/Steitz): Motion by T. LaPointe seconded by A. Steitz to close the Community Center on. The Community Center will be closed on Thursday May 10 and Friday May 11 for installation of the tile in the foyer and bathrooms. All voting yes. Motion carried.
3. Care Program/Enhancement Committee (Frasier/Steitz): Care program is doing well. Councilwoman Frasier reported on the Waterfront project at the Town Park. Construction will not start at the Town Park until after Memorial Day.
4. Finance & Insurance (Frasier/Gladu): Councilwoman Frasier reported that the committee has been keeping track of the Towns finances. We have trying to move as much money as we can into CD’s without tying up all money in case of emergencies.
5. Fire Department (LaPointe/Gladu): No report.
6. Highway (Gladu/LaPointe): Councilman Gladu reported that the Highway Department is doing well Budget wise. We received $65,850.00 in CHIP money. Superintendent Smith reported that the Highway Department has been doing spring clean up of the roads. Supervisor Belden stressed the need to get the culverts/catch basins cleaned out along 9N. Superintendent Smith suggested that the state and LGA should be contacted to resolve the problem and the sediment pond also should be cleaned out.
7. Museum & Historian (Frasier/LaPointe): Councilwoman Frasier reported that the Hague Historical Society will hold a Grand Opening of the Museum on May 20, 2007 from 2 – 4 pm.
8. Personnel (Gladu/Frasier): Councilman Gladu has incorporated all comments into the draft Employee’s Manual. He will give each Board member a copy for their review and recommended changes.
9. Planning/Zoning/Stormwater (Gladu/Frasier): Councilman Gladu reported that the training session was very informative and that there was a large attendance. The Board thanked Cathy Clark for putting this program together. Cathy will be taking her Civil Service Exam next month.

Planning Board:
1. PB has submitted a recommendation for code modification to the Town Board. This began as a request from the Zoning Board of Appeals. The suggested wording; as per Dominick Viscardi; see Attached.
2. The Board has begun work on a Local Law concerning Telecommunication Towers.
Zoning: The Board approved a Variance for a second story addition.
1. Clean-up Day: The ZOE recommends the Town Board once again establishes a Town wide Clean-up day. If approved I will make a sweep of the Town and report any violations to the owner prior to Clean-up day. Last year only a handful of violations remained after the event.
2. N Y State Dept. of State Training Day - Hague - April 25
6 Planning Board members, 4 Zoning Board members, 1 Town Council member and the ZEO attended. One ZBA member has received training through the County. ZEO has created a file for each member to document Training.

3. Town Board must establish a Mandatory Training Law.
4. GIS training: Attend session 5/8/07. The Town may have to purchase additional equipment when new permitting system is in place. All new permit documents will have to be scanned into computer systems and sent to the county. All documents currently in the tax parcel folders will have to be scanned into the system. New permits from the County will be issued and used in all Towns for future project.
All departments will be able to access information concerning parcels. Example: Assessor, Clerks, Zoning, & building departments.
5. Request permission to work July 23, 24, & 25, so I may a attend a function in Maine on the 26th & 27th.
10. Recreation, Promotion & Youth (LaPointe/Steitz): Mr. Meola reported that Warren County Youth have been conducting their Youth Court. The students do a great job.
11. Sewer Dist. #1 & #2 (Belden/Steitz): Supervisor Belden explained that the Board needs to pass a new resolution subject to permissive referendum. The public hearing will be scheduled for May 29, 2007 at 6:30 pm.

RESOLUTION AND FINAL ORDER TO ESTABLISHING
TOWN OF HAGUE SEWER DISTRICT NO. 2
WHEREAS, the Town Board of the Town of Hague has decided to form the Town of Hague Sewer District No 2, in accordance with Article 12A of Town Law, and pursuant to the provisions of Town Law Section 209-e(1); and
WHEREAS, the Town Board authorized Clough, Harbour & Associates, LLP, licensed New York State Professional Engineers, to proceed with the preparation of the Map, Plan and Report; and
WHEREAS, a Map, Plan and Report, dated July 2006 was filed with the Town and is in the possession of the Town Clerk; and
WHEREAS, the boundaries of the proposed district were included in said Map, Plan and Report and are set forth on Schedule A annexed hereto and made a part hereof; and
WHEREAS, the improvements proposed are described in said Map, Plan & Report filed in the Office of the Town Clerk and include the construction of a wastewater collection, conveyance and treatment system and related appurtenances; and
WHEREAS, the maximum amount proposed to be expended for the district is recited to be $3,740,000, of which $3,085,000 of this total amount is to be funded by a United States Environmental Protection Agency Grant to Warren County and all remaining costs to be expended from bonds issued or on behalf of the proposed district, and not from any general town funds; and
WHEREAS, the Capital Cost to the District is $655,000; and
WHEREAS, all costs for the proposed district are to be assessed on a benefit basis to the lots and parcels in the district, in proportion as near as may be to the benefit each derives therefrom; and
WHEREAS, there is not proposed to be any hook up fee levied by the Town for permission to connect to the system; however, the cost for the installation of a service line will be required to be provided by the owner from the building to the property line estimated to cost between $2,000 and $6,000 per parcel, depending on the length of the line and other factors that might be encountered in installing the line; and
WHEREAS, the cost of the district to the typical property in the district is estimated to be $400.00 per year for Operation & Maintenance; and
WHEREAS, Clough, Harbour & Associates, LLP, Licensed New York State Professional Engineers, prepared a Map, Plan & Report dated July 2006 and filed with the Town Clerk, provided for the remaining capital cost to the district of $655,000.00 to be financed by the Town of Hague through the issuance of a bond with an annual debt service for the users of the district based on an estimated 20-year bond period, an interest rate of 5.8%, and an amortized repayment schedule of $55,952.00. The annual debt service of $55,952.00 divided by the total number of EDU's in Sewer District No. 2 equates to $395.00 per EDU. A single family residence rated at 1 EDU would pay an annual operation and maintenance fee of $400.00, together with debt service of $395.00, for a total of $795.00 per year; and
WHEREAS, the Town Board on July 17, 2006 adopted Resolution #60 of 2006 in anticipation of obtaining further grants to fund the remaining cost to the district which did not materialize provided for the capital cost to the district of $655,000.00, to be financed by the cost of the district to the typical property in the district estimated to be $400.00 per year for operation and maintenance and the capital cost to the typical one family home in the district estimated to be $256.00 per year, for a total cost per year of $656.00, and
WHEREAS, the resolution of July 17, 2006 also provided for a public hearing to be held on August 9, 2006; and
WHEREAS, on August 9, 2006 at the public hearing the capital cost to the district of $655.00 was updated as follows: cost to the property owner for capital cost of $395.00 per year, operating and maintenance cost of $400.00 for a total cost of $795.00 per year; and
WHEREAS, the Town Board has caused to be prepared and filed for public inspection with the Town Clerk a detailed explanation of how the cost of the district will be assessed to the typical property in the district and, if different, how the cost to a typical one or two family home in the district was compiled; and
WHEREAS, the requirements of Section 209-d of Town Law require a Public Hearing to be held on the formation of the district; and
WHEREAS, SEQRA documents have been completed prior to the adoption of this Final Order and NEPA documents have been submitted to USEPA; and
NOW, THEREFORE, BE IT RESOLVED AND ORDERED AS FOLLOWS:
RESOLVED AND ORDERED, that the Town Board has determined that all the property owners and all the property within the proposed district are benefited thereby except for property deemed non-buildable by local zoning; and it is further
RESOLVED AND ORDERED, that all property and property owners benefited are included within the limits of the proposed district; and it is further
RESOLVED AND ORDERED, that the Town Board approves the creation of the proposed district, subject to permissive referendum, and the proposed bonds to furnish and finance said district; and it is further
RESOLVED AND ORDERED, that the proposed Map, Plan and Report prepared by Clough, Harbour & Associates, LLP, Licensed New York State Professional Engineers, dated July 2006 and filed with the Town Clerk is hereby approved; and it is further
RESOLVED AND ORDERED, that so much of Resolution #60 of 2006 adopted by the Town Board on July 17, 2006 which provides that the capital cost to the typical property of $256.00 in the district in addition to the annual operation and maintenance fee of $400.00 is estimated to be $656.00 per year to the typical one-family home in the district is hereby rescinded in favor of the capital cost to the typical property of $395.00 per year in the district in addition to the $400.00 annual operation and maintenance fee yielding a total cost of $795.00 per year; and it is further
RESOLVED AND ORDERED, that all steps taken in the establishment of the Town of Hague Sewer District No. 2 and resolutions and any actions taken to date by the Town Board of the Town of Hague relating to the formation of the Town of Hague Sewer District No. 2 are hereby ordered, and as ordered, affirmed and ratified, and this final order for the creation of the Town of Hague Sewer District No. 2 is hereby made as is required by law; and it is further
RESOLVED AND ORDERED, that the Town Board of the Town of Hague is authorized to obtain the USEPA Grant and Bonding in the amount of $3,740,000 for funding said district, of which $3,085,000 of this total amount is to be funded by a United State Environmental Protection Agency Grant to Warren County and all remaining costs to be expended from bonds issued or on behalf of the proposed district, and not from any general Town funds, and upon the further condition that the establishment of the proposed district be approved by the Comptroller of the State of New York upon submission of a completed application to establish the district filed pursuant to Town Law Section 209-f; and it is further

12. Town Park (Steitz/LaPointe): Councilman Steitz reported that applications are coming in for life guards. The following Visitor Center employee’s will be returning for the 2007 summer. Motion by A. Steitz, seconded by T. LaPointe to appoint Susan Adare, Joe McCranels, and Evelyn Gravelle to the Visitor Center booth for the 2007 summer months. The booth will be open for six hours a day, seven days a week. All voting yes. Motion carried.
The full time general park attendants job description will consist of cleaning, cut grass, pull weeds, collect boat fee’s, water flowers.
Motion by A. Steitz, seconded by T. LaPointe to set the rate of pay for the Park Attendant @ $10.00 per hour. The attendants will work 7 days a week. All voting yes. Motion carried.
13. Transfer Station (Steitz/Gladu): No report.
UNFINISHED BUSINESS
1. Motion by A. Steitz, seconded by R. Gladu that Clean-up Day will be scheduled for June 6 & 7 of 2007. One pick-up load per person/parcel. The only items accepted will be metal, furniture, and appliances. The Highway Dept. will pick up for Seniors and Disabled individuals between the hours of 6am – 2pm. Anyone needing pick up should call the Community Center. AYES: Supervisor Belden, R. Gladu, A. Steitz, and E. Frasier. NAYS: T. LaPointe. Motion carried.
2. The Hague Historical Society will hold an open house for the Hague Historical Museum on Sunday May 20, 2007 between 2 pm and 4 pm. Mr. Meola addressed the Board on the name of the museum on the invitations. The museum room is the Clifton F. West Museum, not the Hague Historical Museum. In 1998 The Hague Town Board by Resolution named the museum the Clifton F. West Museum. Most of the items in the museum were obtained by Mr. West. Mr. Meola also stressed that an example of this would be Casella Waste Management. Casella Waste is running the Town of Hague Transfer Station. They are under contract. The Company did not move into the Town of Hague Transfer Station and change the name of the Transfer Station.
The Board will have the committee review this problem.
3. The price per bags will be $3.00 for small and $4.00 per 30 gallon. Casella Waste will be the Town of Hague $300.00 per month for rent. The trash dumpster at the Community Center will remain.
Motion by A. Steitz, seconded by T. LaPointe to authorize Supervisor Belden to sign contract with Casella Waste Management to run the transfer station. All voting yes. Motion carried.

ARTICLE XI
Nonconforming Uses and Structures
§ 160-62. Continuation of nonconforming uses or structures.
A. A structure which is conforming but which contains a lawful nonconforming use, a lawful nonconforming structure which contains a lawful nonconforming use or a lawful nonconforming structure which contains a conforming use may be continued and maintained in reasonable repair but may be altered, enlarged, extended or otherwise increased in any manner whatsoever by up to 25% of its existing square footage as of the date of this chapter (December 12, 1977) in accordance with Subsections A(1) and (2) below, and may be replaced only after approval by the Planning Board following site plan review: [Amended 11-10-1998]
(1) Such alteration, enlargement, extension or other increase shall be limited to the structure itself. The provisions of this section shall not be construed so as to allow the construction of a separate building. For the purposes of this subsection, a building connected to a main structure by a breezeway or similar device shall be considered a separate building.
(2) In no case shall any increase or expansion violate or increase said structure's noncompliance with this chapter.
B. This article shall not be construed to permit any unsafe use or structure or to affect
all proper procedures to regulate or prohibit the unsafe use or structure.

A. A lawful nonconforming structure which contains a conforming use may be continued and maintained in reasonable repair and may be altered, enlarged, extended, replaced and/or relocated in accordance with Subsection B(1) below and may be replaced and/or relocated only after approval by the Planning Board following site plan review.
(1) In no case shall any increase, expansion, replacement, and/or relocation violate a structure's non-compliance with this charter.
C. This article shall not be construed to permit any unsafe use of a structure or to affect all proper procedures to regulate or prohibit the unsafe use of a structure.
The Town Board wishes to send the following code modification to the Adirondack Park Agency for their review and recommendations.
5. Councilman Gladu has discussed the proposed Noise Local Law with the Town Attorney. If we opt to do a Mandatory Referendum on this proposed Local Law the choice would be to hold a special election or to have the proposition put on the ballot for the General Election. Motion by R. Gladu, seconded by T. LaPointe to have the proposition on the proposed Local Law on Noise put on the General Election Ballot in November. All voting yes. Motion carried.
6. Jim O’Toole has been asked to chair the pedestrian and bicycle pathway committee. The first phase of the proposed plan will run from the center of Hague to Silver Bay Association and then hopefully to Friends Point or further north. Grants will be applied for to cover some of the cost of this project. A public hearing will be held once we have a figure of how much this project will cost.
Motion by A. Steitz, seconded by T. LaPointe to send out request for proposals for the preparation of the grant application followed by project design and supervision of the construction project of the proposed pedestrian and bicycle pathway, if approved by NYSDOT. All voting yes. Motion carried.
COMMUNICATIONS & PETITIONS:
1. Motion by R. Gladu, seconded by Supervisor Belden to authorize not more than $500.00 for the time capsule for the Bicentennial event. AYES: Supervisor Belden, R. Gladu, E. Frasier, A. Steitz, and T. LaPointe. Motion carried.
The Board stressed that the Bicentennial Committee should be trying to get more local participations from individuals and groups.

1. RESOLUTION #46 OF 2007
RESOLUTION TO AMEND THE 2007 BUDGET
RESOLUTION INTRODUCED BY R. GLADU, AND SECONDED BY T. LAPOINTE
RESOLVED, that the Town Board amend the Town Budget for fiscal year 2007 by
Increasing Highway Estimated Revenues DA0 510 and Highway Consolidated Improvement Program Revenue DA0 3501 and increasing appropriations DA0 960 and CHIPS appropriations DA0 5680-400 by $33,201 for CHIPS FY 06-07 rollover monies.
DULY ADOPTED BY THE FOLLOWING VOTE:
AYES: Supervisor Belden, R. Gladu, T. LaPointe, A. Steitz, and E. Frasier.
Motion carried.
2. Motion by R. Gladu, seconded by T. LaPointe to authorize Supervisor Belden to work with T. LaPointe on obtaining additional money from NYS for snow and ice removal. All voting yes. Motion carried.
3. Two proposals were received for spring cleanup of Community Center beds and also planting of trees and landscaping at the Hague Town Park.
North Country Landscape & Design:
Community Center $800.00.
Town Park: $1,470.00.
DeFranco Landscaping/Cons.,Inc.:
Community Center: $725.00 with free spring cleaning of the triangle.
Town Park: $1,625.00
Motion by A. Steitz, seconded by E. Frasier to accept North Country Landscaping & Designs proposal in the amount of $1,470.00 for the Town Park landscaping and DeFranco landscaping to and David DeFranco in the amount of $725.00 for the Community Center. All voting yes. Motion carried.
SUPERVISOR REPORTS:
1. 2.83% increase to the school taxes.
2. Silver Bay Association initiated a town committee to work with Silver Bay Association on forming better working relations with the Town.
3. The County will be doing the grant for the proposed Slide Park in Sabbath Day Point sand pit. Application due by June 29, 2007. This will be a matching grant.
Motion by Supervisor Belden, seconded by R. Gladu to have a site plan and review for the proposed slide park in Sabbath Day Point. All voting yes. Motion carried.

Resolution to file application for funds from the New York State Office of Parks, Recreation, and Historic Preservation for a Slide Park in the Town of Hague
Resolution introduced by Supervisor Belden, and seconded by R. Gladu.
RESOLVED:
That Daniel D. Belden, as Supervisor of the Town of Hague, is hereby authorized and directed to file an application for funds from the New York State Office of Parks, Recreation and Historic Preservation in accordance with the provisions of Title 9 of the Environmental Protection Act of 1993 or the Federal Land and Water Conservation Fund Act of 1965, in an amount not to exceed one hundred and twenty thousand dollars ($120,000.00), and upon approval of said request to enter into and execute project agreement with the State for such financial assistance to the Town of Hague for a Sliding Park and, if appropriate, a Conservation easement/preservation covenant to the deed of the assisted property.
