SPECIAL TOWN BOARD MEETING

Supervisor Belden opened the meeting at 5:04 pm.
Members present: Supervisor Belden, R. Gladu, T. LaPointe, and E. Frasier.
Absent: A. Steitz.
Also present: Attorney Viscardi
Motion by Supervisor Belden, seconded by Councilman Gladu to appoint Edna Frasier as Acting Clerk for the purpose of recording minutes. All voting yes. Motion carried.
The purpose of the meeting is to have the Town Board review the Resolution and packet of information that will be submitted to Audit and Control.
Town Clerk present at 5:15 pm.
The Town Attorney, Dominick Viscardi reviewed affidavits with David Martucci, Assessor, Deborah F. Manning, Town Clerk and Judy Stock, Editor of The Hague Chronicle.
Supervisor Belden as Budget Officer of the Town confirmed with the Town Attorney that the Town of Hague has no outstanding indebtedness.

TOWN LAW ARTICLE 12A, SECTIONS 209.c, 209.d, 209.e, 209.f AND 209.g,
STATE FINANCE LAW, SECTION 8(14),
TO ESTABLISH SEWER DISTRICT NO. 2,

RESOLUTION #41 OF 2007
RESOLUTION INTRODUCED BY EDNA FRASIER
SECONDED BY RICHARD GLADU
WHEREAS, the Town Board of the Town of Hague conducted a public hearing on August 9, 2006 for the creation of Sewer District No. 2 in the Town of Hague; and
WHEREAS, by resolution dated October 17, 2006 the Town Board approved the establishment of Sewer District No. 2 including the boundaries thereof as set forth in the Map, Plan and Report for Sewer District No. 2, and authorized the construction of the necessary supply for the purpose of providing public utility for the residents of the District; and
WHEREAS, the resolution was subject to a permissive referendum as provided in Section 209-e of the Town Law; and
WHEREAS, said resolution establishing Sewer District No. 2 was published in the legal advertising section of the Glens Falls Post Star on October 21, 2006; and
WHEREAS, no petition for a permissive referendum has been filed with respect to the establishment of said sewer district;
NOW, THEREFORE, BE IT RESOLVED, that in order to comply with 2 NICER, Chapter III, Part 85, Section 85.3, authority for submitting application, the Town Board states that the attached application was prepared by its Town Attorney at the direction of the Town Board; that the Board believes the contents of the application to be accurate; that the Board had determined that the expenditures for which permission is sought is in the public interest and will not constitute an undue burden on the property which will bear the cost thereof; that the cost of the proposed improvement is to be assessed in whole or in part against a benefit area; that all real property to be assessed will benefited by the proposed improvements and that no benefit property has been excluded.
BE IT FURTHER RESOLVED that the Town Board of the Town of Hague executes this resolution knowing that the State Comptroller will rely on the statements herein made.

ABSENT: Arthur Steitz, Town Councilman
Motion carried.
Motion by E. Frasier, seconded by R. Gladu to adjourn meeting at 5:45 pm. All voting yes. Motion carried.
