The Town Clerk read notice of publication of public hearing on proposed Sewer District #2, published in the Post Star on July 27, 2006.

 

Mr. Robert Flores gave a presentation on the proposed Sewer District #1.

 

Background:

            Hague Sewer District #1 is complete

            $3,085,000 EPA Grant remains

            Waste Water Treatment Plant is capacity is available

            EPA accepts Sewer Dist. #2 concept

 

Wastewater Collection Utilizes Low Pressure Sewers

            4.7 Miles of 1.5 to 4 inch HDPE Pipe

            139 Sewer Connections/Grinder Pumps

            1 Main System pump station

The Town will provide grinder pump and service connection at right-if-way.  The property owner is responsible for installation and hook-up.

 

The creation of a Sewer District has a defined process to follow:

            Public Hearing subject to permissive referendum if not petitioned the Town Board will adopt resolution approving the district and a bond resolution.

 

Upon the passing of a resolution to establish the district subject to permissive referendum, there is an open 30 day period at which time a petition can be filed containing 5% of the voters in the district.

To vote:

Must be a property owner

Everyone listed on the deed has a vote

Absentee voting requires registration

Costs shared by Equivalent Dwelling Units (EDU’s)

 

The EDU Assessment Schedule was compiled using the following schedule:

Vacant Land Adjacent to proposed Sewer District – 0.1 EDU if property id 1 acre or less

Vacant Land not Adjacent to proposed Sewer District – 0.05 EDU

Vacant Land non-buildable per existing Zoning Requirements – 0.0 EDU

 

EDU Assessment Schedule

Single Family homes including Church Parsonages and Mobile homes: 1EDU

Multiple Family Residences: 1 EDU per residence

Seasonal Residence:  1 EDU

Vacant land non-buildable per existing Zoning Requirements:  0 edu

Motels, Inns Cottages: 5 EDU per unit

Restaurants:  2 EDU

Marinas/Clubs 1 EDU

 

There are multiple steps required to coordinate the Sewer District project.  APA permit, NYSDEC-SEQR approval-stream permit, EPA-NPA approval, NYSDOT- Work permit, NYSEFC-Funding submittal, NYSA&C-District Approval and OPRHB-Permit.

 

The proposed cost implementation is as followed:

Capital Cost (estimated for 2007 with 14% Cont.)                 $3,222,000

            Collection System - $3,222,000

            Pump Station - $202,000

 

Engineering (Planning, Design, and

Construction Observation), Legal & Admin Services            $  518,000

 

Total Capital Cost                                                                   $3,740,000

EPA GRANT Money remaining                                            ($3,085,000)

Local Cost to Finance                                                               $   655,000

 

Estimated first year cost per EDU

Capital Cost 655,000 @ 5.8% for 20 years = $55,952/yr

$55,952/yr divided by 141.67 EDU's yields                          $395.00

O&M Cost                                                                              $400.00

Questions and Comments:

Bill Lamy explained that before the Town Board adopts the Resolution for Final Order approving the Establishment of the District.  The SEQR report needs to be completed. This process will take approximately 30 to 45 days.  At this time the Board will reconvene and approve the passing of the resolution, the start of the permissive referendum time line will begin.

 

Peter Spencer, 9496 Lakeshore Drive – Urged the Town Board to extend the proposed District further north to help preserve the lake.

 

Jack Toner, President of Forest Bay Property Owners – The Forest Bay Property Owners our in favor of the possibility of expanding the proposed District further north and hope it goes forward soon.

 

Kathy Allen, President of Friends Point Association – Most of the Friends Point Association members are in favor of the proposed Sewer District #2 project.  There are approximately twenty-eight (28) total seasonal families in Friends Point.  Four families are year around residents; nine (9) other families use their home through the season for a total of thirteen (13) families

 

Lari Dhein, 14 Forest Bay – Questioned the length of time before a vote would be in place if the Town was petitioned.

 

Bill Lamy – The Town Board can not pass the resolution to establish the District until the SEQR report is completed.  The SEQR report will take approximately 30 to 45 days.  The Town has to act on the SEQR first, then 2nd the Board will approve a Resolution to Establish Sewer District #2, subject to permissive referendum.  The waiting period on this resolution is 30 days upon passage.  If no petition is filed.  The project will begin.

 

Attorney Viscardi – If there is a vote, the residences in the District will be able to vote absentee.

 

Jean Conroy, 38 Forest Bay North– How do we register for an absentee ballot?

 

Attorney Viscardi – You will send a request to the Town Clerk for an absentee ballot.

 

Supervisor Belden – There maybe additional money available for an additional extension north of the proposed Sewer District #2.  He is working with the State and the Assembly, and they are willing to try to help us obtain grants.

 

Mike Bruder, 9238 Lakeshore Drive – What is the cost of running the line from the house to the sewer connection and who do we get to do this project.

 

Bill Lamy – It is the responsibility of the property owner to obtain a contractor for this project.  The cost depending on the distance between the house and the lateral can cost anywhere between $2,000 to $6,000.  There will a list of certified contractors available.

 

Art Hatfield, President of the Pine Cove Association – The Association members have had nothing negative to say about the proposed District.

 

Peter Spencer, 9596 Lakeshore Drive – What are the projected costs?

 

Bill Lamy – The updated project cost to the property owner will be

                        $395.00 Capital Cost

                        $400.00 O& M

                        $795.00 total cost per year

 

Lari Dhein, 14 Forest Bay – If the Sewer District is extended beyond the Forest Bay line, will this eliminate anyone in the proposed Sewer District #2?

 

Supervisor Belden – No.  Everyone that is listed in the district will stay in the district.

 

Judy Stock, Lakeshore Drive – In case of a vote, how many signatures will be required?

 

Bill Lamy – 5% of all the people that are qualified to vote.  This includes people named on the deeds, a corporation or partnerships have 1 vote.  The unofficial count is approximately 236 people.

 

A question of when the Sewer District #2 will begin.

 

Bill Lamy – This is a very long approval process.  Approval is needed APA, DOT, USPA most of 2007 will be waiting for approvals.

 

Mary Crosman, 8815 Lakeshore Drive – We are looking forward to Sewer District #2.

 

Dave Pressman, 39 Pine Cove Road – He has been a resident for 37 years.  Is there anyway of losing the grant money.

 

Bill Lamy – The money is securer.

 

Supervisor Belden – thank you for coming.  We will keep you informed.  Art Steitz and I will be meeting with the State and Assembly on August 17, 2006 to discuss the possibility of the extension north. 

 

The public hearing will be kept open until the SEQR reports are complete.
