Members present: Supervisor Belden, R. Meola, L. Megow, and R. Gladu.
Absent: W. Bothe.
Also present: Attorney Viscardi and ZEO Graham Bailey.
Supervisor Belden opened the meeting at 8:32 am.
1.) Onsite Wastewater Treatment Systems:
Mr. Meola and Mr. Bailey reviewed the history of the
Wastewater Treatment systems from the March Board meeting to present. It is Mr. Meola’s position that the ZEO has
no authority under the Hague Code requiring onsite wastewater systems to be
designed by licensed professionals except in those cases referred to in Mr.
Viscardi’s letter of 3/18/2004 to Mr. Bailey.
Mr. Bailey agreed that he had the authority requiring professionals in
the design of wastewater systems within 1000 ft of the

all lawful non-conforming lots less than 1 acre within 1000 ft of
4. Whenever the slope of the property is greater than 15%.
Mr. Viscardi advised the Board that the ZEO has authority for # 1, 2 & 4. The ZEO has no authority for #3, that would require a Local Law.
2.) Local Law #1 of 2003 (Junk Law):
Mr. Viscardi stated that the intent of the Local Law is to remove blight from the community. Junk, be it vehicles or other items are a blight to the community and are covered by the Law and must be removed.
To enforce Local Law #1, the ZEO will
1. Develop with the Town Attorney a letter to be sent to possible violators.
2. If ZEO determines that vehicle is unregistered but not junk, section II of the Law addresses corrective action.
3. If ZEO determines that vehicle is both unregistered and not in a condition for legal use on public highways, that is if major parts of the vehicle are not found therein as described under the term “JUNKYARD” on page 2, the junk vehicles have to be removed or placed out of sight and or subject to penalty.
3.) Town Board Committee:
Attorney Viscardi explained the procedures of the Town Board in respect to meetings: If the Town Board were to set up a meeting, two Board members or the Supervisor can authorize the meeting with posting of notice 2 days in advance.
If a Committee of the Board would like to meet and discuss issues. No approval is needed, but no action can be taken at this meeting. The Committee legally can ask the Town Attorney to be present.
Motion by Supervisor Belden, seconded by L. Megow to go into executive session at 10:05 am to discuss Fisher property matter. All voting yes. Motion carried.

Also present: David Martucci, Assessor, Jon & Diane Trudeau, property owners.
The Board discussed with Mr. & Mrs. Trudeau the Fisher property Act law as it relates to their property. The assessor has the responsibility for the administration of the Fisher Act.
Motion by Supervisor Belden, seconded by R. Meola to return to open session at 10:25 am. All voting yes. Motion carried.
Motion by Supervisor Belden, seconded by R. Meola that the Assessor will send the section of law relating to the Fisher Law to Mr. & Mrs. Trudeau. Upon completion of payment and upon the recommendations of the assessor the property will be reclassified under the Fisher Act. All voting yes. Motion carried.
Motion by R. Meola, seconded by L. Megow to adjourn meeting at 10:30 am. All voting yes. Motion carried.
