CALL MEETING TO ORDER: At 7:00 pm Chairman, EJ Siwek called the meeting to order.

APPROVAL OF MINUTES: MEETING OF: December 3, 2009

Bruce Clark made a motion to approve the minutes of December 3, 2009. John Brown 2nd the motion.  Roll call vote: Ayes- EJ Siwek, Richard Frasier, Pam Peterson, Bruce Clark, John Brown, Mike Cherubini and Martin Fitzgerald, Sr.  Nays-none.  Motion passes 7-0

SUBDIVISIONS:  None

REFERRAL TO THE ZONING BOARD OF APPEALS:  

 

ZEO, Cathy Clark read the following:

1.  MANN (43.13-1-20) 34 Bayberry Lane (TR-1)

The applicant would like to enlarge an existing deck by 120 sq. ft.

Zoning issues: 160-50 B (b) shoreline setback.

 

A site visit was performed on December 11, 2009 by Planning Board members.

Pam Peterson recommended approval of the application with the condition that the deck remains an open deck, no roof, walls or any future enclosure can be added without first going back to the Zoning Board for their approval.  Bruce Clark 2nd the motion. 

Roll call vote: Ayes- EJ Siwek, Richard Frasier, Pam Peterson, Bruce Clark, John Brown, Mike Cherubini and Martin Fitzgerald, Sr.  Nays-none.  Motion passes 7-0

 

ZEO, Cathy Clark read the following:

2.  JANKOSKI ( 42.12-1-20)  2 Lake Forest Lane (TR-1)

The applicant is applying for an after-the-fact approval for a multi-family dwelling.  The owners have made a basement apartment in a single family home on a .33 acre lot.  If the ZBA approves the variance request a Type II site Plan Review will be required.

Zoning issue:  160-56 Multi-family dwelling & 160-23 TR-1 (2) (a)

 

 

JANKOSKI continues:

 

ZEO, Cathy Clark reviewed the application with the Planning Board members.

The following issues were stated:

1)      The original permit application was for a single family dwelling and did not include a finished basement or basement apartment.

2)      Currently multi-family dwellings on a .33 acre lot are not permitted by the zoning codes.

3)      The hardship is self created

4)      The kitchen in the basement is still considered a kitchen even with the stove removed.

5)      There is only one exit from the basement apartment, other than the staircase leading up stairs.

 

Chairman, EJ Siwek stated that there was a CO issued from Warren County for the single family dwelling, however there is no record of it to include a basement apartment.

 

Bruce Clark made a motion to recommend that the Zoning Board deny the application based on the fact that the application is an after the fact application and the conditions for a variance are not met by the correspondences that have been submitted. Also, the property has increased in value because of the illegal dwelling therefore it is not a hardship.  Richard Frasier 2nd the motion.

Roll call vote: Ayes- EJ Siwek, Richard Frasier, Pam Peterson, Bruce Clark, John Brown, Mike Cherubini and Martin Fitzgerald, Sr. Nays-none. Motion passes 7-0

Uptown Store, Parlin. Seating plan

The Planning Board members reviewed the modified seating layout as submitted by SD Atelier Architecture dated December 6, 2009 on behalf of the Uptown Store.
