PUBLIC HEARINGS:

 

            There were no public hearings scheduled.

CALL MEETING TO ORDER:

            Chair, EJ Siwek called meeting to order at 7:00pm

INTRODUCTION OF BOARD MEMBERS:

Chair EJ Siwek, Martin Fitzgerald, Richard Frasier, Pam Peterson, Bruce Clark, ZEO, Cathy Clark and recording secretary, Kim Coffin.

            Absent, John Brown and one vacancy.   

APPROVAL OF MINUTES: MEETING OF: January 8, 2009

            Bruce Clark made the motion to accept the minutes, Pam Peterson 2nd the motion.

Roll Call: Ayes: EJ Siwek, Bruce Clark, Pam Peterson, Martin Fitzgerald and Richard Frasier.

            Nay: None

            Motion passes 5-0

SUBDIVISIONS:

            There were no subdivisions.

 

REFERALS TO THE ZONING BOARD OF APPEALS:

 

ZEO, Cathy Clark read the following:

RIZZA (43.13-1-22) 28 Bayberry Lane (TR-1)

The applicants would like to construct a two story addition to a legal non-conforming house.    The plans call for the run-off of the structure to drain into existing and proposed flower beds.  The property is located within Sewer District #1.

 

Zoning issues:  160-62 more than a 25% increase to a legal non-conforming structure.

                           160-23 Sideline setbacks.

After discussing the contents of the application Bruce Clark made the motion to recommend approval of the application, as submitted, with the following conditions: A native vegetative buffer be planted along the brook.  A more detailed Stormwater retention plan be submitted and implemented for the entire structure.  Pam Peterson seconded the motion. 

Roll Call Vote: Ayes: E J Siwek, Bruce Clark, Dick Frasier, Pam Peterson, Martin Fitzgerald,

Nay: none

Motion passed 5-0 vote

 

 

ZEO, Cathy Clark read the following:

KOROT (42.20-1-8)  15 Buttner Lane (TR-1)

The applicant would like to construct a 150 sq. ft. addition to an existing house which sits 12’ from Jenkins Brook. 

160-50 Shoreline setbacks

The Planning Boards recommendation to the Zoning Board of Appeals is to deny the application, as submitted, due to the following facts:

            1. The addition is substantial given the size of the lot and the size of the structure .

            2. The Planning Board feels that there are other alternatives available to the    applicant which would not bring the structure closer to the brook.

            3. The hardship is self inflicted.

            4. The board feels that if the addition was built so close to the brook the bank of the   brook would be damaged.

            5. If approved the request would make a non-conforming structure more non-            conforming

Bruce Clark spoke briefly about the Department of State training session that he attended.
