Chairman EJ Siwek and Planning Board members Bruce Clark, John Brown, Rolly Allen, Martin Fitzgerald, Sr. and Pam Peterson were present. Dick Frasier was absent.
On a motion made by Bruce Clark, and seconded by Pam Peterson, the minutes of the meeting of August 7, 2008 were accepted as amended.
SUBDIVISIONS:
ZEO Catherine Clark read the following:
1. CLARK (43.5-2-18, 19, & 20) 9015 Lakeshore Drive (Hamlet)
The applicant is requesting a minor subdivision of three lots. If approved a total of 4 lots will be created. Zoning issue: 150-6 Review of a minor subdivision.
Bruce Clark moved, and Pam Peterson seconded, a motion to deem the application complete. The motion was approved 6-0. A site visit was set for Monday, September 8, 2008 at 9 am and the public hearing was set for the next meeting on October 2, 2008 at 7 pm.
REFERALS TO THE ZONING BOARD OF APPEALS:
1. GUERRIER-HINTZE (25.2-1-28) 157 West Hague Road (OC-1)
The applicants would like to build an addition to an existing house that sits 54 feet from a brook. If approved the addition would sit 44’ from the brook. Due to a medical condition the applicants need a bedroom and bath on the first floor. A new septic system was installed July 2008 that will meet the requirements of a 3 bedroom home.
Zoning issue: 160-50 shoreline setback
A trailer with an addition had previously burned. The existing house with the addition will be no closer to the brook than what was on that original footprint. Bruce Clark went on a site visit with Zoning Board members and reported no issues.
Bruce Clark moved, and Rolly Allen seconded, a motion to report to the ZBA that the Planning Board sees no major obstacles and has nothing to recommend. The motion was approved 6-0.

OLD BUSINESS:
ZEO Catherine Clark read:
1. JOHNSTON (60.5-1-5) 8746 Lakeshore Drive (TR-1)
The applicant is proposing a 2367 sq. ft. addition to an existing home, which sits 70’ from the MHW of Lake George. If approved the structure shoreline setback will be 52’ from the MHW of the lake. Zoning issue: 160-23 C. (g) new construction within 100’ of the lake.
A comment echoed by several Board members was that neighboring houses are all on deep lots and are in the range of being back about 70 ft from the Lake.
Mr. Johnston and contractor, Steve Young of Silver Bay Construction were present.
Rolly Allen moved, and Bruce Clark seconded, a motion to approve the application as submitted. Mr. Allen noted that the new construction will move the house closer to the water but within the zoning code setbacks and fits the space that it occupies. Pam Peterson added a condition to put more buffer in with natural, native plantings along the shoreline in front of the addition and that it be put along the shoreline where cutting has occurred up to 30 - 35 ft.
ZEO Clark stated that the applicant will get a stormwater permit from the LGPC.
The motion was approved 6-0.

OTHER BUSINESS:
ZEO Clark reported to the Board, for information purposes, that after receiving copies of the minutes of the last meeting of the Planning Board, Brian Grisi, APA local government coordinator, called her with regard to the Peter Haven application. He noted that if the Planning Board saw proof of the combined use of the existing “boathouse” as storage and recreational they could have approved the replacement structure as submitted. Mrs. Clark said that the Planning Board could amend the application during the review process.
ADJOURNMENT:
The Chairman closed the meeting at 7:55 pm but it was not adjourned as the meeting will be continued at the site visit on September 8th at 9 am in order to do the SEQR report.
