EJ Siwek called the meeting to order at 7:00 pm.
The applicant is requesting approval of a two-lot subdivision of a 33-acre parcel. If approved lot #1 would consist of 21.5 acres and lot #2, 11.5 acres. Minimum lot size in Zone OCI is 2.9 acres.
Ms. Clark read the Notice of Public Hearing as it was published in the Post Star on 12/7/2007.
There were no comments from the audience, either for or against the proposal.
No written comments were received.
At 7:04 pm Bruce Clark moved to adjourn the Hearing until receipt of the final plat from the Amara’s.
Pam Peterson seconded the motion.
Vote: Carried, 4-0

The regular meeting began immediately at 7:04 pm.
Richard Frasier moved, and Pam Peterson seconded a motion to approve the 12/6/2007 minutes as written.

At 7:10 pm the regular meeting was suspended. The Amara Public Hearing was re-opened.
EJ Siwek called for comments from those in attendance.
William Novotny, neighboring property owner questioned the purpose of the subdivision.
Paul Amara, property owner, responded that lot #2, where his home is currently located will remain the same. Lot #1 will be reserved for his children.
At 7:12 pm, hearing no other questions or comments, Richard Frasier moved to adjourn the Public Hearing until the Amara’s produce the final plat. Pam Peterson seconded the motion.

The regular meeting resumed immediately at 7:12 pm.

Subdivision issue: Section 150-4, Submission, classification and review of Sketch Plan; 150-6 Review of a minor subdivision plat
Board members discussed the Site Visit made to the property.
Wetlands are located in the area and should be noted on the final plat.
The Highway Department keeps that section of the road cleared in the winter.
Any environmental concerns would be addressed if and when the property is developed.
There is no power beyond the Amara’s house, only telephone service.
Discussion will continue once the final plat is received.
The applicant would like to replace an existing deck located 61 feet from the lake. If approved the replacement deck would be located 51 feet from the lake. No section of the deck will be covered.
Issues: Type I Site Plan Review; Section 160-23 C (1) (g) new construction within 100 feet from the lake
The Board discussed their Site Visit to the property.
Based on a concern noted at the Site Visit, Ms. Clark informed the Board the owners have stated they do not intend to cover the deck.
Storm-water and erosion concerns were expressed.
There is only grass in the area surrounding the site. Given the proximity of the lake, a vegetative buffer was suggested.
The Warren County Planning Board recommends “No County Impact” with the condition that appropriate storm-water and erosion control measures be implemented.
Bruce Clark moved to approve the application with the stipulations:
The deck will have no coverage.
Any future enclosure will require the homeowner return to the Planning Board.
Storm-water and erosion control measures be instituted to prevent water runoff.
Submit to the ZEO a plan noting the above storm-water control measures, including an appropriate vegetative buffer on the North side.
Pam Peterson seconded the motion.

Code modification - Section 160-10 Structures, 160-50 Shorelines
Once the Planning Board writes it, Town Attorney Viscardi has agreed to review new language.
