TOWN OF HAGUE PLANNING BOARD
JUNE 7, 2007
Call to Order:
There being no public hearings, Chairman Swanson called the regular Planning Board meeting to order at 7 pm. Other Board members present were John Brown, Pam Peterson, Rolly Allen, and Peter Foster while EJ Siwek and Tim Costello were absent. Also present was Cathy Clark, ZEO and Judy Stock, acting recording secretary.
Minutes of May 3, 2007
Rolly Allen had a question about the Glading referral to the ZBA.
He quoted from the minutes: “Mr. Glading, who was in attendance, noted the building is approximately 3 feet from the line. He also confirmed placement of the existing accessory structure is on the Glading property.”
Cathy Clark: This was the accessory structure. It should be noted that that was a question about the placement of the northern line and the house there is a pre-existing and was there.
Rolly Allen: And was the accessory structure actually on his property?
Cathy Clark: Yes, it was.
Rolly Allen moved and John Brown seconded a motion to approve the minutes as submitted. Approved 5-0.
Old Business:
1. GLADING (12.18-1-5) 9606 Lakeshore Drive (TR-1)
Applicant is requesting a Variance for more than 25% increase of square footage to a legal pre-existing non-conforming house. The house sits 45 1/2 feet from the lake. The owner would like to enlarge the second story of house by 600 sq. ft. The foot print of the structure would not increase. Septic is in compliance for the proposed addition.
ZBA approved the Variance request 5-24-07.
Zoning Issues: 160-62 A. Non Conforming structures.
160-23 C. 1, (g) New Construction within 100 feet of body of water.
Chairman Swanson asked ZEO Clark to bring the Board up to date. She stated, “At the May ZBA meeting the ZBA did approve the variance, they did accept the stormwater plan as submitted, and at your May meeting you deferred your judgment until after the ZBA.” Mr. Glading did the stormwater plan. Pam Peterson had hoped that there would be a stormwater plan for both structures. They have addressed the stormwater plan for the new addition but she hoped something could be done about the other house because it is all deck and all ledge.
Pam Peterson moved and Peter Foster seconded a motion to accept the plan for the second story addition as proposed (on the south house) with the condition that, in addition to the stormwater plan for the house with the addition, a stormwater plan is created and implemented for the second (north) house on the property. Both stormwater plans must be submitted to the ZEO prior to getting a compliance certificate.
Vote on the motion: Peterson, yes; Brown, no; Swanson, yes; Allen, yes; Foster, yes. Motion carried 4-1.
2. MARCHETTI (93.8-1-10) 5 Bass Bay Rd. (TR-1R)
Applicant is requesting a 10' x 10' addition to an existing bedroom. The addition, if approved, will be 96' from the shoreline of Lake George.
County Referral: No County impact with the condition of appropriate stormwater and erosion control.
Zoning Issues: 160-24 C (1) b New construction within 100' of a body of water.
ZEO Clark indicated a change in the footage from the shoreline. She and EJ Siwek measured it and it should read 96 feet instead of 69 feet. The change will be sent to Warren County on the referral sheet.
Rolly Allen moved and Peter Foster seconded a motion to accept the application. Motion approved 5-0.
3. CORBO (26.6-1-8) 36 N. Forest Bay Road (TR-1)
At the April 5, 2007 meeting, approval was given for the applicant request for a 12' x 10' deck addition to a pre-existing cabin with the deck being 88' from the Lake. He has requested a change in the approval to reduce the deck 7 1/2 ft towards the lake and have a full width of the cabin and have a full shed roof over the addition.
Rolly Allen moved and Peter Foster seconded a motion to modify the prior approval to allow a covered deck of 16 ft by 7 1/2 ft which will not become additional living space and no part of the structure will be any closer than 92 feet from the Lake. Motion approved 5-0.
Other Business:
1. RYPKEMA (43.5-2-5) 9820 Graphite Mt Rd (Hamlet)
ZEO Clark reported that she had been alerted to the removal of the fence on the property now called the Juniper Shop. When previously approved, the conditions included, “The owner should close off the entrance to the street - replace the gate with fencing.” The condition was imposed because of the danger of the blind corner to pedestrians. ZEO Clark questioned if the removal of the entire fence was a violation of the conditions of approval. She also noted that the new sign was not as the Planning Board had approved. It was suggested that she call Attorney Viscardi.
2. Code Amendments concerning Telecommunication Towers
At the last meeting, the Board agreed that the Town of Bolton has a useable ordinance and Attorney Dominick Viscardi offered to draft wording for review at the next meeting. Since then, ZEO Clark has forwarded his draft to the Planning Board.

Twenty-six definitions were repeated which were pointed out by Rolly Allen.

John Brown suggested the phrase ”...and to protect the natural features and aesthetic character..” be changed to ”...and give due consideration to the natural features and aesthetic character..”

B. Suggestion to change the phrase “...apply to all property within the following zones: town-wide.” to “...apply to all property within the town.”
D. what are the standards referring to in “these standards?”
Section 160-95. Site Plan Review
D. (1) How do you decide “adverse impact?”
F. space in paragraph
G. clarify the meaning of “toe of fill, tap of cuts”
H. should use our term “Zoning Enforcement Officer” instead of “Zoning Administrator”
J. How would “reasonable cost” be determined?
Rolly Allen was adamant that the document was not ready for review.
Cathy Clark urged continuing to work on it.
Dave Swanson said he would go over it and send it on to Attorney Viscardi within the next two weeks.
The Planning Board agreed to meet for an additional session to continue to work on the Telecommunication Ordinance.
