Public Hearing

 

David Swanson called the Public Hearing portion of the meeting to order at 7:00 pm.

 

Waters, (25.4-1-18.11) 239 Decker Hill Rd. SCUZ/OCI

Applicant is requesting a four lot subdivision of a 16.1 acre parcel.

 

The Notice of Public Hearing, appearing in the Post Star on 2/28/2007 was read by Cathy Clark.

 

The applicant’s representative, John Breitenbach spoke in support of the subdivision request.

Mr. Breitenbach offered to answer any question concerning the proposal, but there were none.

 

There being no other comments, written or verbal, the Public Hearing was closed by David Swanson at 7:01 pm.

 

Regular Meeting

 

The regular monthly meeting of the Hague Planning Board was called to order at 7:01 by David Swanson.

 

After introductions, the minutes from 2/1/2007 were approved as written. Motion by Tim Costello, second by John Brown.

Vote: Carried 5-0

Ayes: Allen, Brown, Costello, Peterson, Swanson

Nays: none

 

Subdivisions

Waters, (25.4-1-18.11) 239 Decker Hill Rd. SCUZ/OCI

Cathy Clark noted the Planning Board assigned a negative declaration to the minor subdivision at their last meeting.

 

With no further discussion, Tim Costello moved to approve the subdivision as presented, based on the criteria in the Subdivision Regulations in the Zoning Ordinance. Pam Peterson seconded.

Vote: Carried, 5-0

Referrals to the Zoning Board of Appeals

Nielson, (76.12-1-15) Tower Point Rd. HS-R

Dr. Nielson is requesting approval of an 845 sq. ft deck addition with a hot tub. Construction will be 65 ft. from the shoreline.

 

John Brown and Cathy Clark visited the site. According to Mr. Brown, his only concern related to chlorinated water which might be emptied from the hot tub. John Breitenbach, representing the applicant, stated that the manufacturer suggests the hot tub be drained twice annually, letting the water sit idle for a few days to allow the chlorine to dissipate. The water will then be drained away from the lake. The LGPC has no problem with that plan, according to Mr. Breitenbach.

 

John Brown moved to approve the applicant’s request for the addition of a deck and a hot tub. Tim Costello seconded.

New Business

Szabo (24-1-35) 9150 Graphite Mountain Rd. OCI

Mr. Szabo is requesting a six lot subdivision of his 15.5 acre property under Section 160-61, Gifts, Devises and Inheritance. Mr. Szabo has owned the property since 1968 and intends to gift one parcel to each of his five children, retaining the existing house lot for himself.

 

Noted during discussion:

            A copy of the deed confirming ownership since 1968 is on file.

            An easement may be needed to accommodate the existing leach field.

            All lots will have access from Rt 8.

            Deeds titled in the names of the children should be required.

If the children decide to build, soils and topography in the area appear good.

 

Tim Costello moved to approve, based on the fact the subdivision meets the requirements of Section 160-61,Gifts, Devises and Inheritance, in the Hague Zoning Ordinance, with the condition the mylar with the deeds showing the names of the recipients be recorded at Warren County. Copies should be submitted to the Hague Zoning office. Rolly Allen seconded.

Corbo (26.6-1-8) 36 S. Forest Bay Rd. TR1

The applicant is requesting a 12 x10 ft. deck addition to a pre-existing cabin. Construction will be 88 ft. from the lake. There is also a bunk house located 100 ft from the lake, according to Ms. Clark.

 

A Site Visit was scheduled for 3/30/2007 at 9:00 am. If snow (unplowed driveway) is an issue, Ms. Clark will contact neighbor Hume to access the site from his property.

 

Other business

Section 160-62 code modification: Planning Board members will review Mr. Viscardi’s suggested wording.

 

Public Notice: Although NYS requires 5 days, Mr. Viscardi stated his opinion that the Town should continue with the 10 day requirement for Public Hearing Notice for subdivisions.

 

Definition of square footage, Section 160-10 discussion: All agreed confusion occurs when applied to shoreline setbacks. Also agreement that “attic” is the offending word in the definition.

No action taken.

 

Mr. Viscardi reported on his attendance at the Association of Towns Annual Meeting in NYC. He provided handout materials for several highly contested zoning cases that were reviewed. In his summary, Mr. Viscardi reminded Planning Board members to document their reasons or findings of fact when making decisions.

 

Cathy Clark has prepared a document which will assist Planning Board members when reviewing projects and making decisions.
